The Constitutional Court (MK) held a preliminary hearing on the Dispute over the General Election Results (PHPU) for the election of candidates for Legislative members of  Depok City Electoral District (Dapil), on Tuesday, April 30,2024, in the MK Preliminary Courtroom. Case No. 142-02-0-12/PHPU.DPR-DPRD-XXII/2024 was filed by Hardiyono and Teguh Poedji Prasetyo. The hearing was chaired by Chief Justice Suhartoyo with Constitutional Justice Daniel Yusmic and M. Guntur Hamzah.

Hardiyono, who was present without his legal counsel, said that during the plenary session on March 4, 2024, for the Depok city vote count, Watoni, a witness from the Depok City PKS Regional Executive Board, stated that the C1 results in Kedaung and Sawangan Baru sub-districts showed vote inflation for the Nasdem Party.

"The Prosperous Justice Party (PKS) stated that they had found vote inflation in the Sawangan sub-district, Kedaung sub-district at polling stations 1-2, 14 etc., and in Sawangan Baru sub-district at polling stations 1,4,6,9,10,13,16,19,20 etc., on the C1 Results for the DPR RI," he added

He reviewed and analyzed the meeting's minutes through March 6, 2024, noting the many delays and the reasons for scheduling with the argument of scrutiny. The General Elections Commission (KPU) chairman responded on March 6, 2024, but he did not review the troublesome villages or polling places.

The alleged inflation or addition was also observed directly by the Depok City Elections Supervisory Body (Bawaslu), such as the C1-Results form being erased with correction fluid or scribbled on, which is not the recommended standard of being marked with two checkmarks and initialed, he said the Bawaslu clearly performed poorly.

"It is clear that Bawaslu, as the election supervisory agency for Depok City, which was appointed, should have swiftly taken firm steps against individuals playing within the institution or within the partyaccording to Bawaslu's duties, authorities and functio ns," said he.

Therefore, the Petitioner requested that the Court annul the March 9, 2024 Vote Count Recapitulation, recount the results at the KPPS level, and order the Respondents to correct for the errors. (*)
