KPU: Golkar Candidate for Mimika 2 Has No Legal Standing

JAKARTA (MKRI) — The Constitutional Court (MK) held a follow-up hearing on election results dispute (PHPU) of the House of Representatives (DPR) and Regional Legislative Council (DPRD) on Tuesday, May 7, 2024. The case No. 37-02-04-36/PHPU.DPR-DPRD-XXII/2024 was filed by Yan Sampe, a DPRD candidate for the electoral district Mimika 2 of Central Papua Province.

The hearing to hear responses from General Elections Commission (KPU) as Respondent, Relevant Parties, and the Elections Supervisory Body (Bawaslu) was presided over by the Constitutional Justices Arief Hidayat (panel chair), Anwar Usman, and Enny Nurbaningsih

KPU’s Response

The Respondent’s legal counsel Adrianus Sukanto explained its objections before the Court. According to the Respondent, the Petitioner does not have legal standing for having no recommendation from the central executive board (DPP) of the Party of Functional Groups (Golkar) to file a PHPU petition to the Court. Besides, it deemed the Petitioner's petition unclear or vague.

“The Petitioner only mentioned the votes obtained by Golkar Party legislative candidates number 1-5 in Mimika 5 without making any conclusions regarding the detailed locations of the polling stations where vote inflation had occurred, the number of inflated votes, and the legislative candidates whose votes had been taken,” explained Adrianus.
