JAKARTA (MKRI) — The Constitutional Court held a preliminary hearing on the 2024 general election results dispute for a case filed by Yan Sampe, a candidate for the Regency Legislative Council (DPRD) of the electoral district of Mimika 2. During the hearing, the Petitioner was represented by legal counsel Vitalis Jenarus. The hearing for case No. 37-02-04-36/PHPU.DPR-DPRD-XXII/2024 was held on Monday April 29, 2024, presided over by panel 3: Constitutional Justices Arief Hidayat (panel chair), Anwar Usman, and Enny Nurbaningsih.
“This petition is a request to the Court to cancel the Respondent’s decision, the General Elections Commission (KPU) Decree No. 360 of 2024 for the Mimika Regency DPRD for the electoral district of Mimika 2,” said Vitalis Jenarus.
He continued that the Petitioner had requested the recommendation of the Party of Functional Groups’ (Golkar) central executive board (DPP) three times, but did not receive any response.
In the petition’s subject matter, the Petitioner claimed the Respondent’s version of Golkar’s DPRD votes for the electoral district of Mimika 2 was different the tally at the regency level. The Petitioner alleged that there had been an inflation of votes in Mimika Regency from 2,125 votes to 2,430 votes. The difference was then reported by the Petitioner to the Mimika Regency Bawaslu (Elections Supervisory Body).
“Because there is no plenary meeting at the district level, only at the regency level, we received this information from the D result forms. Based on the form, there is also a difference in vote acquisition at each polling station,” said Vitalis.
In his petition, the Petitioner requests the Court to grant the petition in its entirety and cancel the KPU Decree No. 360 of 2024 and to certify the correct vote count results for the Mimika Regency DPRD candidate Number 1 from Golkar Rizal Pata' with 2,125 votes and for the Petitioner with 2,421 votes.
