JAKARTA (MKRI) — The Constitutional Court (MK) held a follow-up hearing for the DPRD (Regional Legislative Council) election results dispute of Intan Jaya Regency, Deiyai Regency, in electoral district (dapil) Deiyai 3 on Monday morning, May 6, 2024, on Panel 3. The case No. 106-02-01-36/PHPU.DPR-DPRD-XXII/2024 was filed by Agusten Yuppy from the National Awakening Party (PKB). This second hearing was held with to hear the response from the KPU (General Elections Commission) as Respondent and the testimony of Bawaslu (Election Supervisory Board), presided over by Constitutional Justices Arief Hidayat (panel chair), Anwar Usman, and Enny Nurbaningsih.
At the hearing, the Respondent explained that in his petition, the Petitioner alleges that the Deiyai KPU had altered the vote acquisition for PKB, resulting in discrepancies between the C. plano result form and D. result form that were not in line with the C. plano result form and D. result copy based on Bawaslu’s recommendation without coordination with the Kapiraya District election committee (PPK). The correct total vote acquisition for PKB according to the Petitioner based on the C. plano result form and D. result form of Deiyai Regency 3 is 2,034 votes.
Alleged Increase in PKB Votes Inaccurate
The Respondent’s legal counsel Andre Kristian said the Petitioner’s version of his vote acquisition in Kapiraya District and West Tigi District, Deiyai Regency, Deiyai 3 of 2,034 votes is inaccurate. According to the regency/city D. result model form of the Central Papua Province DPRPT (House of Representatives), Deiyai Regency, Central Papua Province, for the electoral district of Deiyai 3 dated March 3, 2024, the Petitioner's vote acquisition was 893 votes.
The KPU also clarified that the alleged vote acquisition for PKB in Kapiraya and West Tigi Districts totaling 2,034 votes is inaccurate. According to the same regency/city DPRPT D. result model form, the vote acquisition on that date was 893 votes. The KPU stated that the Petitioner’s vote acquisition as a a DPRD candidate for Deiyai Regency 3 from PKB is in line with Deiyai Regency Bawaslu’s recommendation that the people’s votes be returned for Kapiraya District DPRD based on the C. results model form.
Therefore, according to the KPU, the Petitioner’s claim of a vote acquisition of 2,035 votes is incorrect as it does not align with the plenary meeting results held at the Kapiraya District Office. Based on Deiyai Regency Bawaslu’s recommendation, the vote acquisition in Kapiraya District of Deiyai Regency conforms with the regency/city DPRPT D. results form of Deiyai Regency, Deiyai 3, totaling 893 votes.
The KPU also explained that votes on the regency/city DPRPT D. results forms of Deiyai Regency, Deiyai 3 had been recapitulated at the regency/city level for the 2024 election, with political party witnesses in attendance, including witnesses from the PKB.

Alleged Election Results Manipulation Revealed
Meanwhile, in its statement, Bawaslu outlined that its monitoring of the vote count recapitulation at the Kapiraya District on February 16, 2024 showed a tally of 850 votes based on photos and video recordings. However, there was a change to 2,034 votes in the D. result form of Kapiraya District.
Addressing this issue, Deiyai Regency Bawaslu received a report of alleged violations in letter No. 001/LP/PL/BWS-DYl/33.28/11/2024 on February 24, 2024 from complainant Obaja Anouw and the accused chairperson and members of the Kapiraya District election committee (PPD), primarily concerning alleged vote count manipulation. The complainant attached evidence related to the Letter of the DPD (Regional Representatives Council) II of Golkar (Party of Functional Groups) in Deiyai Regency No. 005/DPD-GOLKAR/111/2024 dated February 24, 2024, which reported the plenary meeting results at in Kapiraya District, indicating that Agusten Yuppy obtained 850 votes.
Deiyai Regency Bawaslu issued Recommendation No. 001/LP/PP/BWSDYl/33.28/11/2024 on February 28, 2024, advising the Kapiraya PPD and Deiyai Regency KPU to return the people’s votes recorded in C. Result Model form of the DPRD on February 15, 2024 in Kapiraya District, ratified on February 16, 2024 at the district office premises.
The preliminary hearing was presided over by Constitutional Justices Arief Hidayat (panel chair), Anwar Usman, and Enny Nurbaningsih. The Petitioner, who was represented by legal counsel Subani, argued in his petition that the Deiyai Regency KPU has allegedly changed the results of the vote acquisition for PKB so that the C. plano result and D. results forms were not in accordance with the C. plano result and D. copy result forms based on the Regency Bawaslu’s recommendations and without coordination with the PPK in Kapiraya District. The Petitioner believes the total votes for PKB based on the C plano and D result forms in Deiyai Regency 3 should be 2,034 votes.
For this reason, the Petitioner requests that the Court grant his petition in its entirety, to cancel the KPU Decree No. 360 of 2024, and to certify his version of the vote acquisition results for the DPRD election of electoral district 3 of Deiyai Regency, which is 2,034 votes.
