JAKARTA (MKRI) — The Constitutional Court (MK) held a preliminary hearing for the election results disputes (PHPU) for the election of candidates of the Regional Legislative Council (DPRD) of the electoral district (dapil) of Deiyai 3 on Monday, April 29, 2024 in one of the Court’s panel courtrooms. The case No. 106-02-01-36/PHPU.DPR-DPRD-XXII/2024 was filed by Agusten Yuppy, a DPRD candidate from the National Awakening Party (PKB), who alleges that the Deiyai Regency KPU (General Elections Commission) has manipulated votes.

The preliminary hearing was presided over by Constitutional Justices Arief Hidayat (panel chair), Anwar Usman, and Enny Nurbaningsih. The Petitioner, who was represented by legal counsel Subani, argues in his petition that the Deiyai Regency KPU has allegedly changed the results of the vote acquisition for PKB so that the C plano result and D results forms were not in accordance with the C plano result and D copy result forms based on the Regency Bawaslu’s (Elections Supervisory Body) recommendations and without coordination with the subdistrict election committee (PPK) in Kapiraya District.

The Petitioner believes the total votes for PKB based on the C plano and D result forms in Deiyai Regency 3 should be 2,034 votes.

Petitioner’s Objection Ignored by KPU

Subani stated that during the vote recapitulation meeting by the Deiyai Regency KPU, the Petitioner had officially filed an objection and requested that the agreed noken vote counting system be applied. However, the Deiyai KPU ignored the objection.

For this reason, the Petitioner requests that the Court grant his petition in its entirety, to cancel the KPU Decree No. 360 of 2024, and to certify his version of the vote acquisition results for the DPRD election of electoral district 3 of Deiyai Regency, which is 2,034 votes.
