JAKARTA (MKRI) — The General Elections Commission (KPU) stated that it had carried out the recapitulation of the tiered vote count results correctly following applicable provisions. The Respondent (KPU) denied the Petitioner’s version of the vote acquisition in case No. 183-01-14-16/PHPU.DPR-DPRD-XXII/2024 for the election of the DPR (House of Representatives) in the electoral district of Banten Province II and the DPRD (Regional Legislative Council) in the electoral district of Tangerang City 1.
“In essence, we assert that Petitioner’s version of the vote acquisition version is incorrect because the correct version is the Respondent’s version in accordance with the tabulation at 20 polling stations (TPS) disputed by the Petitioner,” said the Respondent’s legal counsel Petrus P. Ell in the plenary courtroom on Monday, May 6, 2024.
The Respondent explained that the KPU of Serang City carried out the recapitulation of the vote count results in Serang City along with witnesses, including the Petitioner’s witnesses, on March 4-5. Meanwhile, the recapitulation of the vote count results in the Banten Province was held on March 6. At that time, specifically for Serang City, there was a special occurrence/objection by the Democratic Party, which basically asked for the votes at 78 polling stations to be compared.
For this objection, Banten Provincial KPU requested an opinion from the Banten Provincial Bawaslu (Elections Supervisory Body), which suggested to officially report the issue. The Petitioner’s witness recorded an objection in the special occurrence/provincial objection D-form.
According to the Respondent, the correct vote count for the DPR membership of Banten Province II is as follows: the Indonesian Democratic Party of Struggle (PDI-P) received 143,703 votes and the Democratic Party received 142,279 votes. Meanwhile, the correct vote acquisition of the Tangerang City DPRD for electoral district 1 is that Golkar (Party of Functional Groups) received 12,814 votes and the Democratic Party received 12,751 votes, in accordance with subdistrict D-result form. These results are in accordance with the KPU Decree No. 360 of 2024 on the certification of the 2024 legislative election results of the DPR (House of Representatives), DPD (Regional Representatives Council), and Provincial and Regency/City DPRD (Regional Legislative Council) announced nationwide.

PPK in Three Subdistricts Were Wrong
Meanwhile, Bawaslu provided information that there were differences in the vote acquisition for PDI-P between the C.copy-DPR form and the D.results-regency form in several polling stations in Serang Subdistrict. Serang City Bawaslu ordered the Serang City KPU to carry out a re-examination of the Serang Sub-district D.result form by comparing the C.result forms at the polling stations as described in the incident through the KPU’s vote recapitulation information system (Sirekap) application. Then the Serang City KPU conducted direct comparisons between the C.copy-DPR and the subdistrict D.Results -DPR forms.
In addition, Banten Provincial Bawaslu has given a decision stating that PPK (subdistrict election committee) of Taktakan, Walantaka, and Baros have been proven legally and convincingly to have violated procedures and mechanisms in the implementation of the recapitulation of vote counting results at the subdistrict and regency/city levels. Those PPK were also given a warning not to repeat or commit acts that violate statutory provisions.
In addition to KPU and Bawaslu, this hearing was also attended by PDI-P and Golkar. The case was heard by Chief Justice Suhartoyo and Constitutional Justices Daniel Yusmic P. Foekh and M. Guntur Hamzah on Panel 1.
Previously, in its petitums, the Democratic Party asks the Court to cancel KPU Decree Number 360 of 2024 on the certification of the 2024 legislative election results of the DPR, DPD (Regional Representatives Council), and Provincial and Regency/City DPRD. The Petitioner also requests the Court to determine the correct vote acquisition according to the Petitioner for PDIP for the members of the DPR Banten II in the 2024 legislative election as many as 141,929 votes. It also requests the Court to determine the correct vote count for the Tangerang City DPRD in electoral district 1: the Democratic Party with 12,819 votes and Golkar with 12,673 votes.
