JAKARTA (MKRI) — The Democratic Party has filed a 2024 election results dispute (PHPU) petition to the Constitutional Court (MK). In the Case No. 183-01-14-16/PHPU.DPR-DPRD-XXII/2024, the party argues that there was a reduction in its votes in Tangerang City electoral districts (dapil) 1 and 2 for the Regional Legislative Council (DPRD) of Banten Province.
The Petitioner’s legal counsel Mehbob said that fundamental violations occurred in the 2024 legislative Election, especially in Tangerang City, because the General Elections Commission (KPU) and the Elections Supervisory Body (Bawaslu) had allowed administrative problems to occur. The KPU and Bawaslu had violated existing laws and regulations, violated the principle of direct, public, free, confidential, honest, and fair election so the 2024 legislative election in Kaliwates Subdistrict, Tangerang City has lost legal legitimacy.
“Therefore, the a quo petition must be examined without taking into account the winner’s votes determined in the recapitulation plenary meeting held by the Respondent,” said Mehbob in the plenary courtroom on Monday, April 29, 2024.
Based on the KPU Decree No. 360 of 2024, the Democratic Party’s vote acquisition for the DPR seats in the electoral district of Banten 2 reached 142,279 votes, while that for the Indonesian Democratic Party of Struggle (PDI-P) reached 143,703 votes. The Petitioner stated that PDI-P’s vote tally should be reduced by 1,774 votes, bringing the total to 141,929 votes. Thus, the Democratic Party’s vote acquisition in Banten 2 for the DPR seat should be 142,279 votes, which was greater than votes for PDI-P, with a difference of 350 votes.
In its petitum, the Petitioner asks the Court to annul KPU Decree No. 360 of 2024 on the nationwide certification of the 2024 presidential and legislative election results. It also asked the Court to order the KPU to compare vote data from the C result forms with the D result forms specifically for PDI-P in the DPR election for Banten II in Nyapah Village, Walantaka Subdistrict at polling stations (TPS) 6 and 8; Kuranji Village, Taktakan Subdistrict at TPS 2, 5, 9, and 11; Lialang Village, Taktakan Subdistrict at TPS 1, 2, 3, 4, 5, 6, 9, 10, 14, 15 and 18; Taman Baru Village, Taktakan Subdistrict at TPS 5, 7, 9, 10, 11, 12, 14, 16, and 17; Panggung Jati Village, Taktakan Subdistrict at TPS 1, 3, 4, 9, 11, 12, 13, 14, 15, 16, 17, 20, and 21; Unggul Tengah Village, Taktakan Subdistrict at TPS 1, 2, 3, 4, 6, 10, 11, 12, 13, and 14; Cibendung Village, Taktakan Subdistrict at TPS 5 and 8; Pancur Village, Taktakan Subdistrict at TPS 1, 2, 6, and 8; Drangong Village, Taktakan Subdistrict at TPS 4, 5, 10, 11, 14, 15, 19, 20, 22, 27, 28, 38, 45, 46, 47, 50, and 51; Sepang Village, Taktakan Subdistrict at TPS 20 and 33; Kalanganyar Village, Taktakan Subdistrict at TPS 2, 3, 4, 5, 6, 7, 8, 9, 10, and 11; Cilowong Village, Taktakan Subdistrict at TPS 1, 2, and 9; Baros Village, Baros Subdistrict at TPS 1, 2, 10, 12, and 16; Cisalang Village, Baros Subdistrict at TPS 6; Curug Agung Village, Baros Subdistrict at TPS 4; Padasuka Village, Baros Subdistrict at TPS 4, 5, and 6; Sidamukti Village, Baros Subdistrict at TPS 1, 2, and 8; Sindang Mandi Village, Baros Subdistrict at TPS 1, 2, 3, 4, 6, 9, 12, 13, 14, and 15; Suka Indah Village, Baros Subdistrict at TPS 1, 2, 8, 9, and 11; Sukacai Village, Baros Subdistrict at TPS 1, 4, 5, 6, 7, and 8; Sukamanah Village, Baros Subdistrict at TPS 1, 2, 10, 13, and 18; Tejamari Village, Baros Subdistrict at TPS 4, 5, 7, and 9; Sinar Mukti Village, Baros Subdistrict at TPS 1, 2, 4, and 7.
The Petitioner also asks the Court to order the KPU to make a recapitulation of the overall vote tally by combining the results of the vote tally at those polling stations and then create an overall vote recapitulation for the DPR member candidates in Banten II. The Petitioner asked the Court to determine that according to the Petitioner, the correct vote tally for PDI-P for the DPR election for Banten II in the 2024 election was 141,929 votes.
In addition, the Petitioner submitted a petitum for the Court to fill in the Tangerang City DPRD for electoral district 1. It asks the Court to cancel KPU Decree No. 360 of 2024 regarding the vote acquisition of the Party of Functional Groups (Golkar) for Tangerang City 1 for the Tangerang City DPRD election; Babakan Village, Tangerang Subdistrict at TPS 23 and 42; Buaran Indah Village, Tangerang Subdistrict at TPS 36, 60, and 71; Tanah Tinggi Village, Tangerang Subdistrict at TPS 66 and 05; Cimone Village, Karawaci Subdistrict at TPS 18; Nusa Jaya Village, Karawaci Subdistrict at TPS 25; Babakan Village, Tangerang Subdistrict at TPS 42 and 23; Tanah Tinggi Village, Tangerang Subdistrict at TPS 13, 20, 84, and 63; Cikokol Village, Tangerang Subdistrict at TPS 33 and 36; Buaran Indah Village, Tangerang Subdistrict TPS 66; Suka Asih Village, Tangerang Subdistrict at TPS 07; Kelapa Indah Village, Tangerang Subdistrict at TPS 16. The Petitioner also asks the Court to determine the correct vote results according to the Petitioner for the Tangerang City DPRD in electoral district 1 with 12,819 votes for Democrat and 12,673 votes for Golkar.
The case No. 183-01-14-16/PHPU.DPR-DPRD-XXII/2024 was heard in Panel 1 led by Chief Justice Suhartoyo and Constitutional Justices Daniel Yusmic P. Foekh and M. Guntur Hamzah.
