Court Develops Risk Control Plan in Resolving 2024 Election Cases

JAKARTA (MKRI) — The Constitutional Court (MK) held a focus group discussion (FGD) on the follow-up on risk management reinforcement in the preparation for the resolution of 2024 general election results disputes (PHPU) on Wednesday, December 6, 2023 on the sixth floor of the Court’s third building. The FGD speakers were from the Financial and Development Supervisory Agency (BPKP).

The Court’s Inspector Kurniasih Panti Rahayu hoped that the results of the FGD would generate a risk management follow-up plan for handling PHPU cases since the draft follow-up plan must be implemented in order to reduce or minimize the risks during the settlement of the 2024 PHPU cases.

“In preparing for these potential risks, let’s formulate together what steps to take—SOPs, policies, and any other activities,” Rahayu said in her speech.

PHPU Handling Risks

Head of the Inspectorate’s Administration Division Arshinta Fitridiyani said that the event was a follow-up to a workshop on risk management for the preparation of the 2024 in September 2023 in Tangerang. Identified risks must be followed up with a control action plan (RTP) so that these risks can be prevented, reduced, or minimized.

Arshinta explained that the Court had identified potential risks in the resolution of the 2024 PHPU cases. There are 384 risks covering three stages, including 113 risks in the petition submission and registration stage, 224 risks in the hearings stage, and 47 risks in the administrative settlement and case document stage.

“Today, you will be creating a follow-up action plan for the risks that exceed risk tolerance. So, you will receive support for the technical and substance aspects from fellow auditors who have been CRMO-certified (certified risk management officer),” said Arshinta.

Risk Identification

Meanwhile, Law Enforcement Supervision Coordinator of BPKP Nugroho Sri Danardono explained that risk management is crucial to prevent identified risks from occurring in the resolution of the 2024 PHPU cases. He said, the results of risk identification can be categorized into four groups: fraud, conflict of interest, strategic, and operational risks. After the categorization, the control action plan (RTP) is prepared and monitored for implementation and effectiveness.

“Don’t just commit, the important thing is that the formal documents are complete. Its implementation needs to be monitored, whether it’s related to timeliness or other factors,” said Nugroho alongside BPKP associate auditor Ma’ruf Hidayat.

The FGD was divided into three groups according to the stages in the resolution of PHPU cases, such as pre-hearing, hearing, and post-hearing. The FGD was conducted with the assistance of auditors and then each group presented the results of its discussion.
