Court Issues Decrees on Petitions by Finance Ministry’s DGT ASN

JAKARTA (MKRI) — The Constitutional Court (MK) granted the withdrawal of petitions by a state civil apparatus (ASN) of the Directorate-General of Taxation (DJP) of the Ministry of Finance, Meidiantoni. Chief Justice Anwar Usman read out the Decrees No. 120/PUU-XXI/2023, 121/PUU-XXI/2023, 125/PUU-XXI/2023, and 133/PUU-XXI/2023 at a ruling hearing on Monday, October 23, 2023 in the plenary courtroom.

Through the case No. 120/PUU-XXI/2023, which challenged Article 7A of the 1945 Constitution, Chief Justice Anwar revealed that on August, 28 the Court had received the petition. On September 27 or before the preliminary examination hearing, the Court had received an email on the withdrawal of the petition.

To follow up on this, the Court held a hearing on October 2 to confirm the withdrawal. Based on the withdrawal request and Article 35 paragraphs (1) and (2) of the Constitutional Court Law, a justice deliberation meeting (RPH) was held on October 5, which concluded that the withdrawal was legally grounded and the Petitioner cannot re-file the petition.

“[The Court] stipulates, grants the withdrawal of the Petitioner’s petition; declares petition No. 120/PUU-XXI/2023 on the judicial review of the 1945 Constitution of the Republic of Indonesia against the extraordinary session of the MPR of the Republic of Indonesia for alleged criminal violations by the president and vice president of the Republic of Indonesia withdrawn; declares the Petitioner unable to resubmit the petition; orders the Chief Registrar of the Constitutional Court to record the withdrawal of petition No. 120/PUU-XXI/2023 in the electronic constitutional case registration book (e-BRPK) and return a copy of the petition file to the Petitioner,” said Chief Justice Anwar Usman delivering the decree at the hearing, which the Petitioner attended virtually.

The Petitioner filed the petitions No. 120/PUU-XXI/2023 on Article 7A of the 1945 Constitution, No. 121/PUU-XXI/2023 on Law No. 48 of 2009 on Judicial Power, No. 125/PUU-XXI/2023 on Law No. 51 of 2009 on the Second Amendment to Law No. 5 of 1986 on the State Administrative Court, and No. 133/PUU-XXI/2023 on Law No. 8 of 2011 on the Amendment to Law No. 24 of 2003 on the Constitutional Court.
