JAKARTA (MKRI) — The Constitutional Court (MK) handed down Decree No. 110/PPU-XXI/2023 on the judicial review of Law No. 28 of 2022 on State Budget for the Fiscal Year 2023 on Wednesday, September 27, 2023 in the plenary courtroom. The petition was filed by Meidiantoni, an individual Indonesian citizen.
The hearing was presided over by Chief Justice Anwar Usman and the other eight constitutional justices. With the decree, the Court granted the withdrawal of the petition.
“[The Court] grants the withdrawal of the Petitioners’ petition,” said Chief Justice Anwar reading out the decree.
He stated that, in accordance with Article 34 of the Constitutional Court Law, the Constitutional Court had held a preliminary examination hearing on September 21, 2023 to hear the Petitioner’s statement. The Petitioner asked the Court to conduct a judicial review of the law and organize civil and or criminal proceedings for officials and employees of state institutions.

The Constitutional Court received the petition on September 4 and, in accordance with Article 34 of the Constitutional Court Law, it held a preliminary hearing on September 20. Following Article 39 of the Constitutional Court Law, it advised the Petitioner to revise the petition. However, at the preliminary hearing scheduled to hear the subject matter, the Petitioner withdrew the petition. “Yes, I am withdrawing this petition,” the Petitioner said.
He argued that as a Directorate-General of Taxation (DJP) officer of the Ministry of Finance, he had often submitted date on state revenues and expenditures. Therefore, if the Bank Indonesia Annual Budget (ATBI) is included in Law No. 28 of 2022, he would be able to convey concrete data to the public. In addition, he alleged that the a quo Law has the same function as the ATBI. Therefore, to create administrative order, the ATBI material should be included in the 2023 State Budget Law.
“[The Court] grants the withdrawal of the petition; declares petition No. 110/PUU-XXI/2023 on the judicial review of Law No. 28 of 2022 on the State Budget for the Fiscal Year of 2023 (2023 APBN Law) against the 1945 Constitution of the Republic of Indonesia withdrawn; states that the Petitioner cannot resubmit the a quo petition,” said Chief Justice Anwar reading out the decree with the Petitioner attending online.
