Trainers Convention Discusses Preparation for Election Dispute Resolution

BOGOR (MKRI) — The Trainers Convention for the Technical Assistance Program (bimtek) for the Resolution of Disputes over 2024 Election Results (PHPU) was still ongoing at the Pancasila and Constitution Education Center (Pusdik) of the Constitutional Court (MK) on Thursday, January 26, 2023 in Bogor, West Java. On the second day of the event, Constitutional Justices Arief Hidayat and M. Guntur Hamzah delivered their presentations.

Constitutional Justice Arief Hidayat stated that the object in the PHPU of the presidential election is the KPU’s (General Elections Commission) decision on the certification of the presidential election vote acquisition, which would affect the presidential ticket candidates eligible to participate in election runoff, or the selection of the presidential ticket candidates. Furthermore, he explained that a petition on the presidential election results can be filed to the Court offline or online no later than 3 (three) days after the certification of the vote count results of presidential election.

Meanwhile, Constitutional Justice M. Guntur Hamzah explained the stages of PHPU of 2024: submission of petition, report to the justice deliberation meeting (RPH), registration of petition in the electronic constitutional case registration book (e-BRPK), sending of petition copies to Respondent (KPU) and relevant parties, RPH on relevant parties, determination of relevant parties, sending petition copies to relevant parties, announcement of hearing schedule, preliminary examination, submission of written answers, evidentiary hearings, RPH, Constitutional Court ruling, and delivery of ruling. He also informed the participants that the petition can only be filed once and that pieces of evidence must be numbered and labeled before being submitted to the Court.

Election Management and Monitoring System

A Bawaslu (Elections Supervisory Body) member and a KPU (General Elections Commission) member also delivered presentations at the convention. Bawaslu member Totok Hariyono delivered a presentation on the Election Monitoring System in 2024. He said elections are not only carried out by the KPU, but also by Bawaslu, and both serve as a unit of a national, permanent, and independent election organizer.

He further explained two main objectives of election supervision. First, to evaluate the implementation of the election based on agreed or accepted standards. Second, to ensure that no deviations and violations occur.

“Towards the first goal, a few observers can be involved using a sample, but for the second goal, a large number of strong observers is required,” he emphasized.

In addition, Bawaslu takes action by resolving disputes over the election process. As an informant, it will make efforts to enforce the law in stages that have already been resolved by Bawaslu, which are likely also part of the evidence in the PHPU.

Meanwhile, Andi Krisna, head of the KPU’s Legal Advocacy and Dispute Resolution Bureau, delivered a presentation on the evaluation of the 2019 Simultaneous General Election and information on the 2024 Simultaneous General Election.

“The needs to be a law on the evaluation of information system as a legal basis for the use of the information system so that the application developed by the KPU is not vulnerable to litigation. Meanwhile, the purpose of this information dissemination is to provide information that encourages public participation,” he explained.

Andi revealed the challenges in the implementation of the 2024 Election such voter participation. He added that 2024 would be very complex since the elections of the president, the legislative members, and the heads of regions will be held in the same year.

The Trainers Convention on the Technical Assistance Program (bimtek) for the Resolution of Disputes over 2024 Election Results (PHPU) was organized by the Court’s Pancasila and Constitution Education Center (Pusdik) on Wednesday-Saturday, January 25-28, 2023. Substitute registrars and expert assistants to constitutional justices were in attendance. Constitutional justices, the KPU (General Elections Commission), Bawaslu (Elections Supervisory Body), and others will deliver presentations on the implementation and supervision of the 2024 General Election, the curriculum of bimtek on PHPU, the Court’s procedural law on PHPU, and the Court’s PMK No. 1 of 2022 on the stages and schedule of the general election.

“Kegiatan ini menjadi ajang koordinasi yang baik antar para calon pengajar dan fasilitator dalam rangka menyambut penyelenggaraan Bimtek PHPU yang sudah di depan mata. Selain itu, kegiatan ini juga dapat mensinkronkan pemikiran, interpretasi dan juga pemahaman kita bersama demi tercapainya tujuan Bimtek yang maksimal,” kata Ketua MK Anwar Usman saat menyampaikan sambutan pada pembukaan kegiatan ini pada Rabu (25/1/2023).

The Trainers Convention brought together prospective trainers, facilitators, and organizers of bimtek on PHPU 2024. “This event is a good coordination platform between prospective trainers and facilitators in anticipation of the implementation of the upcoming bimtek on PHPU. In addition, it can synchronize our ideas, interpretations, and understanding to achieve the goal of the bimtek optimally,” said Chief Justice Anwar Usman in his opening speech on Wednesday, January 25.
