SURABAYA (MKRI) — Secretary-General M. Guntur Hamzah spoke at the National Law Student Conference at the Law Faculty of Airlangga University (FH Unair) on Friday, November 18, 2022. He delivered a presentation on “Legal Reform in Indonesia” before law students and lecturers of Unair and delegations from various universities.
He began his presentation by talking about law as a tool of social engineering, law as a tool of social balancing, dan law as a tool of social control. The legal development process in Indonesia, he said, must include legal institution, legal substance, legal awareness and culture, as well as legal facilities and infrastructure.
He also said that legal reform must follow technological developments, so it takes courage to implement information and communications technology (ICT). In addition, there must be the belief that the technologies to apply with brings convenience to the community.
Guntur also said that ICT stands for integrity, cleanliness, and trustworthiness. Integrity is defined as human capital that ensures there is no loss of human identity. Cleanliness is freedom from corruption and self-serving acts. Meanwhile, trustworthiness is the most important element in the enforcement of law in the era of disruptions. Therefore, law students must be following technological developments, have integrity, live clean, and be trustworthy.
Thus, he added, ICT must not be interpreted only as information, communication and technology but as integrity, cleanliness, trustworthiness. When technology is understood only as a tool, the man behind the tool could utilize it inappropriately.
No less important, he added, is that law students must understand the citizens’ constitutional rights that are guaranteed in the Constitution. In relation to this, the Court has launched 66 citizens’ constitutional rights icons (i-HKWN), which consist of 34 icons of individual rights, 29 icons of collective rights, and 3 icons of the rights of vulnerable people. Legal reforms must also protect and respect these rights.
