Court Launches 66 Icons of Citizens’ Constitutional Rights

JEMBER, Public Relations—In collaboration with the Association of Constitutional and Administrative Law Lectures of Indonesia (APHTN-HAN) and the Law Faculty of the University of Jember (FH UNEJ), the Constitutional Court (MK) launched the citizens’ constitutional rights (HKWN) icons on Monday, December 27, 2021. Chief Justice Anwar Usman delivered a keynote speech at the event alongside Secretary-General M. Guntur Hamzah. UNEJ Rector Iwan Taruna with UNEJ Dean and APHTN-HAN Secretary-General Bayu Dwi Anggono were in attendance.

At the event, which took place at the same time as the finalization of the FGD on the reflection of the Court’s performance in 2021 and projection for 2022 on “The Development of the Constitutionalism of Indonesia,” Justice Anwar detailed the Court’s achievements since its founding on August 13, 2003. The Court, he said, had received 3,317 cases, consisting of 1,479 judicial review cases, 29 state interagency authority dispute (SKLN) cases, 676 general election dispute (PHPU) cases, and 1,133 regional election dispute (PHP Kada) cases.

“Meanwhile, in 2021 the Court has received 212 cases, consisting of 121 judicial review cases—50 cases from 2020, 71 from 2021. Until today [this year], the Court has ruled on 99 cases, 3 SKLN cases, and 151 PHP Kada cases. In 2021 there have been 275 cases, with 22 judicial review cases still being reviewed,” he explained.

Public Transparency

Meanwhile, Secretary-General M. Guntur Hamzah reported that this collaboration between the Court’s and its intellectual partners was a real form of mutual and complementary relations according to their respective jurisdictions. Through such an activity, the Court intended to find out about the academic partners’ perspectives on the development of Indonesia’s constitutionalism as it is important for the Court to find its direction in line with Pancasila and the 1945 Constitution.

In 2021, the second year into the pandemic, Guntur said, the Court made innovations that prioritized access to digital information for the sake of public transparency, which is a necessity today.

“The Court is obligated to fill the demand for creative innovations in terms of judicial and administrative aspects. At the beginning, various court data and information were in written form, then gradually transformed into digital form, starting from online petition filing until the ruling,” he said at the event held in compliance with strict COVID-19 protocol in the hall of FH UNEJ.

The Court’s launching of the citizens’ constitutional rights (HKWN) icons to disseminate information about the citizens’ constitutional rights enshrined in the 1945 Constitution. As such, the Court created 66 icons within the category of individual rights, collective rights, and the rights of the marginalized.
