JAKARTA, Public Relations—The Constitutional Court (MK) granted the request to withdraw the judicial review of the Regulation of the Minister of Education and Culture No. 50 of 2015 on the General Guidelines for Indonesian Spelling System (Permen PUEBI) on Wednesday, November 24, 2021 in the plenary courtroom. The case No. 52/PUU-XIX/2021 was filed by Ludjiono, a retired civil servant at the Health Office of Situbondo Regency, East Java.

At the preliminary hearing, the Petitioner asserted that the Ministerial Regulation No. 50 of 2015 was not in line with Article 36 of the 1945 Constitution as it does not regulate the spelling of names of persons. He requested that the Court order the Government to stipulate a legal basis for Indonesian alphabets.

"[The Court] declares to grant the withdrawal of the Petitioner’s petition,” said Chief Justice Anwar Usman pronouncing the decree alongside the other eight constitutional justices.

He added that pursuant to Article 34 of the Constitutional Court Law, the Constitutional Court had examined the petition at a preliminary hearing on October 11, 2021. In addition, pursuant to Article 39 of the Constitutional Court Law, the panel of justices had provided recommendations to revise the petition.

The Court had also held a panel hearing to examine the revised petition on October 25. At the hearing, the Petitioner withdrew the petition. Pursuant to Article 35 paragraphs (1) and (2) of the Constitutional Court Law, the justices had decided in a justice deliberation meeting (RPH) on November 2 that the withdrawal request was legally sound and, thus, the Petitioner cannot re-file the petition.
