JAKARTA, Public Relations—The Constitutional Court (MK) held another judicial review hearing for the Regulation of the Minister of Education and Culture No. 50 of 2015 on the General Guidelines for Indonesian Spelling System (Permen PUEBI) on Monday, October 25, 2021 in the panel courtroom. The case No. 52/PUU-XIX/2021 was filed by Ludjiono, a retired civil servant at the Health Office of Situbondo Regency, East Java.

At the second (petition revision) hearing, the Petitioner changed the norm to review to Law No. 24 of 2009 on the National Flag, Language, Emblem, and Anthem and withdrew the petition.

“The judicial review (of the Ministerial Regulation on PUEBI) is not under the Constitutional Court’s purview so I changed it to Law No. 24 of 2009 on the National Flag, Language, Emblem, and Anthem,” he said at the hearing presided over by Constitutional Justices Daniel Yusmic P. Foekh (chair), Wahiduddin Adams, and Manahan M. P. Sitompul.

However, after listening to the justices’ direction on the procedure to file a petition in the Constitutional Court, the Petitioner also conveyed his wish to withdraw the petition. “I’m withdrawing this petition verbally, but the judicial review of Law No. 24 of 2009 will be entered as a new petition,” he explained.

At the preliminary hearing, the Petitioner asserted that the Ministerial Regulation No. 50 of 2015 was not in line with Article 36 of the 1945 Constitution as it does not regulate the spelling of names of persons. He requested that the Court order the Government to stipulate a legal basis for Indonesian alphabets.
