JAKARTA, HUMAS MKRI - Mahkamah Konstitusi (MK) kembali menggelar sidang kedelapan dalam perkara pengujian Undang-Undang Nomor 3 Tahun 2020 tentang Perubahan Atas Undang-Undang Nomor 4 Tahun 2009 tentang Pertambangan Mineral dan Batubara (UU Minerba) pada Selasa (8/6/2021). Dalam kesempatan ini, Mahkamah menggelar sidang untuk tiga perkara sekaligus, yakni Perkara Nomor 59/PUU-XVIII/2020, Nomor 60/PUU-XVIII/2020, dan Nomor 64/PUU-XVIII/2020. Agenda sidang adalah mendengarkan keterangan Saksi yang dihadirkan Alirman Sori dan tujuh Pemohon lainnya selaku Pemohon perkara Nomor 60/PUU-XVIII/2020. 

JAKARTA, Public Relations—The Constitutional Court (MK) held the eight judicial review hearing of Law No. 3 of 2020 on the Amendment to Law No. 4 of 2009 on Mineral and Coal Mining on Tuesday, June 8, 2021 for cases No. 59/PUU-XVIII/2020, No. 60/PUU-XVIII/2020, and No. 64/PUU-XVIII/2020. The Petitioners of the case No. 60/PUU-XVIII/2020 presented a witness by the name of Ismet Djafar, an expert staff of the House’s Commission VII in 2017-2019.

Ismet Djafar selaku Tenaga Ahli Komisi VII DPR RI 2017-2019 yang hadir dalam persidangan secara virtual ini dalam kesaksiannya mengatakan bahwa rancangan UU Minerba (RUU Minerba) telah masuk dalam Program Legislasi Nasional (Prolegnas)  2014–2019 dan kemudian telah pula menjadi prioritas pada Prolegnas Tahun 2019. Ismet bercerita bahwa Dewan Permusyawaratan Rakyat (DPR) sudah menyampaikan kepada Pemerintah draf RUU Minerba dan menunggu Daftar Inventarisasi Masalah (DIM). Selanjutnya, sambung Ismet, Pemerintah menyerahkan DIM yang belum ditandatangani secara lengkap oleh pihak-pihak yang berkepentingan dalam hal tersebut. Barulah pada September 2019, Pemerintah mengembalikan draf RUU Minerba tersebut untuk selanjutnya dibawa ke forum DPR khususnya ke Komisi VII DPR RI.

In his testimony, Ismet revealed that the mineral and coal mining bill was included in the 2014-2019 National Legislative Program (Prolegnas) and the 2019 Prolegnas priority list. He said that the House (DPR) had submitted the bill to the Government and was waiting for the problem inventory list (DIM). The Government then handed the DIM that hadn’t been signed by all stakeholders. Only in September 2019 did the Government returned the bill, which was then brought to the House’s Commission VII.

“Pada 25 September 2019 dilakukan penyerahan DIM UU Minerba dari Pemerintah pada komisi VII dan saya menyaksikannya. Selanjutnya tidak ada lagi persidangan lanjutan dan kemudian undang-undang ini disahkan,” cerita Ismet dalam sidang yang yang dipimpin Ketua MK Anwar Usman.

“On September 25, 2019, the Mineral and Coal Mining DIM was handed over by the Government to the Commission VII, which I witnessed. There were no more follow-up sessions and then the bill was passed,” he said before the hearing chaired by Chief Justice Anwar Usman.

The case No. 60/PUU-XVIII/2020 was filed by H. Alirman Sori and seven other petitioners. They claimed that their constitutional rights were violated because the formation of the law was discussed exclusively and privately without transparency as stipulated by existing laws and regulations. The discussion of the bill didn’t involve the DPD when it has the authority mandated by the Constitution in discussing bills relating to the relationship between the central and regional government as well as the exploration of natural resources and other economic resources. 

Meanwhile, the petition No. 59/PUU-XVIII/2020 was filed by Kurniawan, a researcher at Sinergi Kawal BUMN, an organization focusing on monitoring, responding to, and providing input to SOEs in mining and coal. He believes the Mineral and Coal Mining Law regulates the relationship between the central and regional government as well as the exploration of natural resources. This means that the discussion of the Mineral and Coal Mining bill required the involvement of the Regional Representatives Council (DPD) as the people entrusted the DPD to represent regional interests in the formation of the law. 

The petition of case No. 64/PUU-XVIII/2020 was filed by by Helvis, an advocate specializing on mining, and Muhammad Kholid Syeirazi, the secretary of Nahdlatul Ulama’s Scholars Association (ISNU). They challenge Article 169A, which they believe has granted the minister too broad an authority to guarantee the extension to extend special mining business license (IUPK) and reduced the role of BUMN (SOEs) and BUMD (Regional Government-Owned Enterprises). They believe it to be against Article 75 of the Mineral and Coal Mining Law. 

Before concluding the hearing, Chief Justice Anwar Usman informed that the hearing would resume on Thursday, June 17, 2021 at 11:00 WIB to hear a witness for the Petitioners of case No. 60/PUU-XVIII/2020 and two witnesses for the Government.
