JAKARTA (MKRI) — Five university students who petition for the material review of Article 27A and Article 45 paragraph (4) of Law No. 1 of 2024 on the Second Amendment to Law No. 11 of 2008 on Electronic Information and Transactions (EIT Law) failed to attend the preliminary hearing for Case No. 163/PUU-XXIV/2026 on Monday, May 18, 2026. The students are Nova Ayu Br. Simanjuntak, Diva Maharani, Dewiantoro Trilas Pilda Faulisa, Marsha Widya Asmoro, and Malik Fahad.
They also failed to confirm their attendance despite summons. Deputy Chief Justice Saldi Isra, who chaired the panel, highlighted lack of seriousness shown by the Petitioners in filing the petition.
“The Petitioners had been duly summoned, and the hearing had already been scheduled. However, it turned out that by the time of the preliminary hearing to hear the points of the petition, they had neither provided any confirmation nor appeared before the Court. Therefore, the Petitioners in this case may be said to be not serious in filing the petition. Accordingly, this panel will convey the matter at the justice deliberation meeting,” the Deputy Chief Justice stated.
For information, the Petitioners filed a petition for the material review of Article 27A and Article 45 paragraph (4) of the EIT Law on the grounds that these provisions have led to broad and inconsistent interpretations, or are open to multiple interpretations, thereby potentially leading to differences in the application of the law in similar cases. The Petitioners argued that the challenged provisions do not provide clear boundaries regarding conduct that is permitted and prohibited by law, particularly with respect to expressing opinions through electronic media. They believe such circumstances create opportunities for inconsistent law enforcement and may potentially result in discriminatory application.
