JAKARTA (MKRI) – 12th-grade students of SMA Negeri 95 Jakarta visited the Constitutional Court (MK) on Wednesday, February 11, 2026. This activity aimed to familiarize them with the Court, from its authorities and obligations to the requirements for becoming a constitutional justice, including the Indonesian constitutional system.

The presentation was delivered by Constitutional Court Legal Analyst, Siswantana Putri Rachmatika, familiarly known as Tika. She stated that the Court was established because there was no clear mechanism for resolving constitutional law issues in the past. Before the amendments to the 1945 Constitution, Indonesia did not have a judicial institution with the authority to review laws against the constitution.

"Because many laws were problematic, but at that time there was no mechanism for reviewing laws against the 1945 Constitution," said Tika in the Hall of Building I of the Constitutional Court, Central Jakarta.

She explained that, as mandated by Article 24C paragraphs (1) and (2) of the 1945 Constitution, the Constitutional Court has the authority to review laws against the Constitution, decide on disputes over the authority of state institutions (SKLN) whose authority is granted by the Constitution, decide on the dissolution of political parties, and resolve disputes regarding general election results. The Court is also required to issue a decision on the opinion of the House of Representatives (DPR) regarding alleged violations by the President and/or Vice President under the 1945 Constitution.

Meanwhile, she mentioned that there is also another highest judicial institution in Indonesia besides the Constitutional Court, namely the Supreme Court (MA), which has different authority. MA has the authority to review regulations under the Law against the Law.

The Supreme Court oversees general, religious, military, and state administrative courts. The Constitutional Court, on the other hand, has no branches, with only one located in the nation's capital.

Supreme Court decisions can be subject to judicial reconsideration (PK). Constitutional Court decisions are final and binding from the moment they are pronounced, and there is no other legal remedy.

Furthermore, Tika also outlined several requirements to become a constitutional justice. Generally, constitutional justices must possess integrity and an impeccable personality, be just, be statesmen with a thorough understanding of the constitution and state administration, and not hold concurrent positions as state officials, as mandated by Article 24C paragraph (5) of the 1945 Constitution. Furthermore, specific and administrative requirements are regulated in Article 15 paragraphs (2) and (3) of the Constitutional Court Law. These requirements include being Indonesian citizens with a doctorate and a bachelor's degree in law, a minimum age of 55 years, and at least 15 years of work experience in the legal field.

Tika emphasized that constitutional justices are prohibited from holding concurrent positions as other state officials, members of political parties, entrepreneurs, advocates, or civil servants. This is emphasized in Article 17 of the Constitutional Court Law.

"To avoid conflicts of interest, constitutional justices must be independent," said Tika.

This educational visit is expected to foster constitutional awareness from an early age among the younger generation, particularly in understanding the constitutional rights guaranteed by the 1945 Constitution of the Republic of Indonesia. The visit concluded with a group photo session and the presentation of certificates as mementos of the students' visit to the Constitutional Court. (*)
