Two Citizens Revise Their Petition to Review National Anthem Law

JAKARTA (MKRI) – Setyo Waluyo and Pungki Harmoko delivered Revised Petition No. 35/PUU-XXIV/2026 regarding the material review of Article 60 paragraph (2), Article 60 paragraph (3), and Article 61 of Law No. 24 of 2009 on Flag, Language, and National Symbol, as well as National Anthem (Law No. 24 of 2009) to the Constitutional Court (MK) on Tuesday, February 10, 2026. Both admitted to having revised several parts of their petition starting from the authority of the Constitutional Court, legal standing or legal standing on the qualifications and losses of the constitutional rights of each Petitioner, as well as the petitum or things wanted by the Petitioners.

Petitioners, represented by their legal counsel, Nana Turyana, then immediately read the petition petitum. "Based on the matters above, the Petitioners request the Court to review and decide on the petition as follows: Grant the Petitioners' Petition in its entirety," he said at the Corrective Examination Session in the MK Courtroom.

In addition, Petitioners requested the Court to declare Article 60 paragraph (2) of Law 24 of 2009 to be in conflict with the 1945 Constitution of the Republic of Indonesia (UUD NRI) and not have binding legal force as long as it is not interpreted as follows: "The National Anthem accompanied by musical instruments is sung in full, one strophe, with one repetition in the refrain"; and to declare Article 60 paragraph (3) of Law 24 of 2009 to be in conflict with the 1945 Constitution of the Republic of Indonesia and not have binding legal force as long as it is not interpreted as follows: "The National Anthem not accompanied by musical instruments is sung in full, one stanza, with one repetition in the third verse of the first stanza"; and stated that Article 61 of Law No. 24 of 2009 is contrary to the 1945 Constitution of the Republic of Indonesia and has no binding legal force as long as the phrase "If" is not interpreted as meaning: "If the National Anthem is sung in full in three stanzas, the third verse in the second and third stanzas is sung once again."

In the preliminary examination hearing on Wednesday, January 28, 2026, the Petitioners admitted to being activists who socialized the song Indonesia Raya being sung in three stanzas both offline and online, but often received criticism from netizens because they considered the Petitioners to have changed the national anthem. According to the Petitioners, the legal fact that occurred was that in singing the national anthem, a habit of singing in only one stanza version had been created. This was caused by the existence of options/choices in singing the national anthem in the legislation that allowed it to be sung in one stanza or three stanza versions, starting with the existence of Government Regulation No. 44 of 1958 on National Anthem Indonesia Raya.

Petitioners believe that the three-stanza version of Indonesia Raya represents the original version and a cultural heritage that should be preserved by all Indonesians. However, the tradition of singing the one-stanza version of Indonesia Raya is so deeply rooted that most Indonesians are only familiar with the one-stanza version, including during flag ceremonies at school.

Article 60 paragraph (2) states "The National Anthem accompanied by musical instruments, is sung as a complete strophe, with one repetition in the chorus." Article 60 paragraph (3) reads “National Anthems which are not accompanied by musical instruments, are sung in full for the first stanza, with one repetition in the third stanza of the first stanza.” Article 61 states "If the National Anthem is sung in three stanzas, the third verse in the second and third stanzas is sung again once."(*)
