JAKARTA, MKRI – The Constitutional Court (MK) and the Regional Representative Council of the Republic of Indonesia (DPD RI) officially signed a Memorandum of Understanding (MoU) and a Cooperation Agreement on Institutional Coordination in the Field of Law and Constitution. The signing took place on Wednesday afternoon (12/03/2025) at the DPD RI Secretariat General Building in Senayan, Jakarta.
The agreement was signed by Secretary General of the Constitutional Court Heru Setiawan and Secretary General of the DPD RI Mohammad Iqbal. The MoU will guide both institutions in strengthening coordination, particularly in enhancing institutional cooperation in legal and constitutional matters, promoting constitutional awareness, and advancing the implementation of e-government and e-court systems within each institution.
Secretary General of the Constitutional Court Heru Setiawan emphasized the importance of this cooperation in supporting the constitutional duties of both institutions. “This cooperation is of exceptional urgency, especially in linking the core duties of the DPD and the Court in examining, adjudicating, and deciding cases,” he said.
He explained that through this agreement, the Court will provide a dedicated platform for handling cases involving the DPD. “Just appoint one or several people as administrators. After logging in, they can immediately filter DPD cases without going through mkri.id. The DPD’s written statements can be uploaded directly, eliminating the need to attend hearings for presentations,” he added.
He also underscored the Court’s role in ensuring public understanding of the Constitution. “Decisions of the Court bind all citizens, with erga omnes effect. Therefore, every citizen has an interest in the Court, particularly regarding constitutional rights guaranteed under Articles 27 to 34 of the 1945 Constitution,” he stated, noting that the cooperation will also strengthen public education on Pancasila and the Constitution.
Meanwhile, Secretary General of the DPD RI Mohammad Iqbal expressed appreciation for the swift and responsive drafting process. “In less than a month, the MoU drafting was completed. The process was very much aligned with our objectives,” he said.
He noted that information technology plays a key role in supporting institutional transparency. “With today’s technology and information systems, the public can openly access the information products we provide. This serves as legitimacy for our presence,” he observed.
He further stated that the MoU will be followed by concrete implementation within each institution. “We want to adopt this best practice within the parliamentary environment. Synergy and coordination must be truly felt in future implementation,” he affirmed.
The signing ceremony was also attended by Head of the Bureau of Organization, Membership, and Personnel (OKK) Fitriani Badar; Head of the Center for Legal Policy Design and Review Andi Erham; several heads of centers and bureaus; the DPD RI Inspector; and Head of the Division for Public Relations and Domestic Cooperation of the Constitutional Court Andi Hakim.(*)
