JAKARTA (MKRI) – A group of representatives of the board and members of the Indonesian Cyber Law Council participated in a virtual workshop on Judicial Review Procedural Law, on Tuesday, October 28, 2025. Constitutional Justice Enny Nurbaningsih attended the session as a source person.
Justice Enny elaborated on the establishment of the Constitutional Court (MK), as an institution that serves as a balancing institution to legal products issued by lawmakers. The formation of a law, she explained, through a long process, thus requiring public participation and the presence of an institution as balance mechanism to control its implementation does not infringe upon citizens’ constitutional rights.
“This shows that in a state with a large population, the principle of democracy have been felt the impact in the practice of constitutionalism as one of the result of reformation. There is now an increase in judicial review submissions from the younger generation to the Court. This reflects a development in how university students interpret laws, showing vigilance in preventing laws from becoming instruments of abuse,” said Justice Enny in response to a participant’s question from Medan.
In addition, Justice Enny explain that any case ssubmitted by Petitioners to the Court will be examined by the constitutional justices. In simple terms, the Court reviews issues concerning the constitutionality of the norms resulting from the enforcement of a law.
“Through this workshop, participants will gain knowledge regarding the Court’s procedural law knowledge that will greatly assist Petitioners in drafting petitions and articulating how a legal norm contradicts the Constitution,” Justice Enny added while responding to another participant.
During the program, Justice Enny also provided clear explanations regarding various matters that may potentially violate citizens’ constitutional rights, including the interpretation of legal norms within laws.
“Interpreting a norm does not mean the Court oversteps its duties or constitutional mandate. It is actually carried out to ensure that legal uncertainty does not arise from the implementation of a norm,” she affirmed.
Justice Enny encouraged all participants to fully engage in the workshop. The session offers opportunities to learn, deepen understanding, and even practice petition drafting in accordance with procedural law, therefore participants will be more capable of understanding constitutional principles and identifying any excesses of authority by other institutions that may harm citizens’ rights.
