SMP Amore Prime School Learns about the Constitutional Court

JAKARTA, (MKRI) – Around 185 students and nine teachers from SMP Amore Prime School, Tangerang City, visited the Constitutional Court (MK) on Tuesday (10/21/2025). They attended a session to learn about the Court, presented by Legal Analyst Andhyta Andam Nadia, accompanied by Legal Analyst Siswantana Putri Rachmatika.

Andhyta explained that the Constitutional Court holds the authority to adjudicate at the first and final instance, with rulings that are final, in matters concerning the review of laws against the 1945 Constitution of the Republic of Indonesia, disputes over the authority of state institutions whose powers are granted by the Constitution, dissolution of political parties, and disputes concerning general election results. The Court is also obliged to decide on the House of Representatives’ opinion regarding alleged violations committed by the President and/or Vice President under the Constitution.

“However, up to this day, the Court has never ruled on the dissolution of a political party or the impeachment of a president or vice president,” said Andhyta during the session at the Main Hall of Building I, Constitutional Court, Jakarta.

She further explained that the judiciary in Indonesia consists of the Supreme Court (MA) and the Constitutional Court (MK), supported by the Judicial Commission (KY) as a complementary institution to uphold judicial integrity. One of the main distinctions between MA and MK is that the Constitutional Court reviews laws against the 1945 Constitution, while the Supreme Court reviews regulations below the level of law against existing laws.

Andhyta emphasized that the Constitutional Court serves as the guardian of the Constitution by ensuring that laws and actions of state institutions do not contradict the Constitution and by protecting citizens’ constitutional rights. Constitutional rights are the rights possessed by every citizen, guaranteed by the Constitution in each country. In Indonesia, these rights are safeguarded by the 1945 Constitution, including Article 27 paragraph (1), which enshrines the principle of equality before the law, meaning that every citizen has equal standing before the law and must obey the law and government without exception, regardless of social status, rank, or group; and Article 28A, which stipulates that every person has the right to live and to defend his or her life and existence.

Therefore, every citizen who believes that his or her constitutional rights and/or authorities have been harmed by the enforcement of a law may file a petition for judicial review of that law against the 1945 Constitution with the Constitutional Court. Petitioners may include individual Indonesian citizens or groups with a common interest, customary law communities still recognized and aligned with societal developments and the principles of the Unitary State of the Republic of Indonesia (NKRI), legal entities (public or private), or state institutions.

“This is what the Constitutional Court safeguards—the very heart of every petition lies in the violation of constitutional rights,” Andhyta stated.

The students also had the opportunity to visit the Constitutional History Center (Puskon) located on the 5th and 6th floors of the Constitutional Court Building in Jakarta. The Puskon serves as an educational platform documenting the history of the Constitution and the Court through a combination of information, art, and advanced technology such as holograms and interactive touchscreens, aimed at enhancing public awareness of the Constitution.
