Court Designs a Disability-Friendly Procedural Law Consultation Service

JAKARTA  (MKRI) – Secretary General of the Court (MK), Heru Setiawan, opened the Coaching Clinic on Disability-Friendly Procedural Law Consultation Services at the Court on Friday, October 10, 2025, at the Court’s Building II Auditorium. In his remarks, Heru stated that the participants in this event are staff members who interact directly with the public in their daily duties.

“I noticed that the participants here are those who serve the public every day, those who meet and assist the parties directly. So, it’s fitting that we’re having this discussion with them,” said Heru.

He explained that the Court serves various parties involved in constitutional proceedings, including petitioners, the government, the House of Representatives (DPR), and the people, particularly in fulfilling the constitutional mandate to protect citizens’ constitutional rights.

“It would be meaningless for the Court to have such extraordinary authority if its services are not inclusive,” Heru emphasized.

He further expressed his hope that there would be no service gap between non-disabled and disabled persons so that everyone can equally access justice. “Everything we do must have an impact, and that impact should be access to justice. If what we do hasn’t yet made an impact, then we must continue until it does,” Heru asserted.

Acting Registrar of the Court, Wiryanto, stated that this Disability-Friendly Procedural Law Consultation initiative is a new design developed by the Bureau of Legal Affairs and Registrar Administration. He highlighted the importance of providing excellent, inclusive, and professional services. Therefore, Wiryanto appreciated the presence of Gufroni Sakaril, Chairperson of the Advisory Council of the Indonesian Association of Persons with Disabilities (PPDI), whose insights would be valuable for the Court in drafting regulations related to disability-friendly consultations.

He further explained that officers providing consultation services must be able to deliver complete and clear explanations to the public while maintaining the confidentiality of the Court’s decisions. According to Wiryanto, the participation of resource persons would broaden the Court’s understanding of how to better serve people with disabilities, including ensuring the availability of facilities and proper treatment for individuals with mental disabilities who require special service.

In his presentation titled “Interacting and Communicating with Persons with Disabilities,” Gufroni Sakaril explained the concept of disability to the Court’s staff who participated in the coaching clinic. He noted that persons with disabilities are ordinary individuals who have certain limitations but share the same aspirations as others, to advance, pursue education, work, and participate in politics. Disabilities, he added, may exist from birth or arise later due to incidents such as accidents or illness.

Gufroni further emphasized that under Law No. 8 of 2016 on Persons with Disabilities, the treatment of persons with disabilities is a matter of human rights, not an act of charity as regulated under Law No. 4 of 1997 on Persons with Disabilities. He also elaborated on appropriate ways to treat and communicate with persons with various types of disabilities, hearing, visual, speech, physical, and psychosocial. Gufroni explained that PPDI played a key role in the drafting of the Disability Law, which was formulated by the association in collaboration with legal and linguistic experts.
