JAKARTA (MKRI) — The Constitutional Court (MK) held a preliminary hearing to confirm the withdrawal of case No. 171/PUU-XXIII/2025 concerning the judicial review of Law No. 18 of 2003 on Advocates (the Advocates Law) on Wednesday, October 1, 2025, in the Courtroom.
The petition was filed by Fendi Darmawan, who challenged the constitutionality of Article 3 paragraph (1) letter g of the Advocates Law. The article stipulates that one of the requirements for advocate appointment is a mandatory two-year consecutive internship at an advocate’s office.
At the hearing presided over by Deputy Chief Justice Saldi Isra, the Petitioner, who attended the session online, declared the withdrawal of his petition.
"That’s correct, I, as the Petitioner, have withdrawn the petition. The reason for this withdrawal is that I have found an alternative resolution through another mechanism," Fendi explained.
Responding to this, Deputy Chief Justice Saldi Isra stated that the withdrawal would be brought to the justice deliberation meeting (RPH) for further determination. “We will inform you of the outcome once it is decided,” he remarked.
Previously, in his petition, Fendi requested that the Court declare Article 3 paragraph (1) letter g of the Advocates Law unconstitutional and not legally binding insofar as it is not interpreted that the internship period may be recognized from the time a law student undertakes practical training or works under the supervision of an advocate. He asserted that this should apply as long as the internship is conducted genuinely, continuously, and fulfills the two-year requirement stipulated in the Advocates Law.
