Court Dismisses Bangka Regent Election Dispute Petition of Naziarto–Usnen

JAKARTA, MKRI – The Constitutional Court (MKRI) dismissed the petition in the Bangka regent election result dispute filed by Candidate Pair Number 2, Naziarto–Usnen. The ruling in Case No. 333/PHPU.BUP-XXIII/2025 was delivered on Monday (29/9/2025) in the Plenary courtroom of the Constitutional Court.

In the Court’s legal considerations, Constitutional Justice Enny Nurbaningsih stated that the Petitioner’s argument concerning an alleged violation of formal requirements in the registration of Candidate Pair Number 5, specifically the validity of the Senior High School equivalency diploma belonging to Rato Rusdiyanto, was legally groundless.

The Petitioner also alleged a violation in the registration of Candidate Pair Number 1, claiming they had not submitted the required statement of not being declared bankrupt at the time of registration, yet were still declared “Eligible” by the Respondent.

In response, the Respondent argued that at the time of registration, Candidate Pair Fery Insani and Syahbudin had each submitted the required statements confirming their eligibility and that no reports or findings of electoral violations had been recorded against them.

After examining the Petitioners’ arguments, the Respondent’s response, the Related Party’s statement, the clarification from the Bangka Regency Bawaslu, and the evidence submitted, the Court found that the Respondent had accepted the registration of Candidate Pair Fery Insani and Syahbudin on June 27, 2025. The registration documents included, among others, a Statement of Non-Bankruptcy dated June 26, 2025, signed by each candidate.

The statement was submitted as an initial requirement for candidacy, as the official Certificate of Non-Bankruptcy— which should have been issued by the competent District Court—was still in the verification process. Prior to this, Candidate Pair Fery Insani and Syahbudin had consulted with the Respondent as the election organizer. Regarding the document in question, the Respondent had also clarified its validity with the Central Jakarta District Court, which was recorded in Minutes No. 51/PL.02.2-SD/1901/2025 dated July 1, 2025. The minutes confirmed that the official Certificate of Non-Bankruptcy was still under verification by the Central Jakarta Class I A Special District Courts.

Meanwhile, Justice Enny Nurbaningsih referred to Bangka Regency KPU Decree No. 113 of 2025, which amended Decree No. 107 of 2025 on the program and schedule for the stages of the repeat election of the Bangka Regent and Deputy Regent. Under the decree, the period for correcting and submitting improvements to administrative requirements for candidates was set for 6–8 July 2025. Accordingly, the submission by candidate pair Fery Insani and Syahbudin of the court-issued certificate stating they were not under bankruptcy proceedings was made within the prescribed timeframe.

On this basis, the Court found the Petitioner’s allegation—that candidate pair No. 1 failed to submit the non-bankruptcy certificate at the time of registration—unfounded and without legal merit.

Previously, the Petitioner questioned the validity of Rato Rusdiyanto’s diploma and alleged a vote discrepancy of 21,982 votes between the Petitioner and the Related Party. The Petitioner also accused the Bangka Regency KPU of mishandling the verification of candidacy documents and suspected collusion with candidate pair No. 5. (*)
