Court Strengthens Transparent Procurement Governance

JAKARTA, MKRI-Secretary-General of the Constitutional Court (MK) Heru Setiawan affirmed that the Court’s environment is now free from practices that could harm the institution.

“Now there is a guarantee, an assurance, that we are all clean. Our echelon II officials are clean, yesterday we conducted a thorough clean-up. If we still find one or two issues, we take firm action and dismiss them. Our main capital now is a clean Court environment,” Heru said.

Heru expressed confidence that the integrity of echelon II officials is a key foundation for realizing transparent procurement governance. He urged employees to speak up whenever they have doubts about a colleague’s integrity.

“If you are convinced something is not yet clean, communicate it. Report it. This is what I mean by step by step. This is a component for achieving the Procurement Governance Index (ITKP),” he explained.

As a follow-up to Presidential Regulation Number 46 of 2025 on Government Procurement of Goods/Services and the implementation of Electronic Catalog Version 6 (e-Catalog V6), the Constitutional Court held the “Socialization of Presidential Regulation Number 46 of 2025 and Technical Guidance on the Implementation of Electronic Catalog Version 6.” The event took place on Wednesday-Thursday, 17–18 September 2025, at the Hall of the Court’s Building I and was opened with direct remarks by Secretary-General Heru Setiawan.

On the first day, Wednesday, September 17, 2025, sessions cover Presidential Regulation No. 46 of 2025 and the Circular Letter of the Head of the National Public Procurement Agency (LKPP) No. 1 of 2025, delivered by Ardian Wibowo Sugiarso and Mulia Saputra, First Expert Policy Analysts of LKPP’s Directorate of General Policy Development and Strategy. A subsequent session on strengthening the Procurement Governance Index is presented by Astri Widya Sartika, First Policy Analyst at LKPP’s Directorate of Planning, Transformation, Monitoring, and Evaluation of Procurement.

On the second day, Thursday, 18 September 2025, three advanced topics were discussed: Implementation and Development of e-Catalog V6; Procurement of Construction Works through e-Catalog V6; and Payment Stages in e-Catalog V6. The materials were delivered by representatives from LKPP’s Directorate of Digital Market and the Jakarta I State Treasury Service Office (KPPN Jakarta I) of the Ministry of Finance.

The program is expected to deepen understanding, improve governance, and support effective implementation of government goods/services procurement through e-Catalog V6 as an important instrument to ensure transparency and accountability.

Regarding procurement practices, Heru reminded work units not to delegate the entire process to the General Bureau without a clear strategy. “Echelon II officials cannot just pass everything to the General Bureau. They must first have a strategy. You cannot just hand over everything; specifications and objectives must be clear. Procurement must aim for the price most beneficial to the state,” he emphasizes.

He also highlights the importance of market knowledge and unit price analysis to ensure efficiency and effectiveness. “To determine the most beneficial price for the state, we must have expertise and understand the market. If we do not, invite resource persons who do. The knowledge gained must benefit the state in terms of price, completion time, and quality,” he concludes.
