Jakarta (MKRI) – The Constitutional Court (MK) granted the withdrawal of the material judicial review petition on Article 169 letter q of Law No. 7 of 2017 on the General Election (General Election Law). The pronouncement hearing of Case No. 146/PUU-XXIII/2025 petitioned by Advocates Bahrul Ilmi Yakup, Iwan Kurniawan, Yuseva, and Rio Adhitya was held on Wednesday, September 17, 2025.
Chief Justice Suhartoyo mentioned that the Court had received a letter from the Petitioners regarding the petition withdrawal, which had been confirmed during a hearing.
The Justices' Deliberation Meeting on September 3, 8, and 9, 2025, granted that the withdrawal is reasonable by law. Therefore, the Petitioner may not resubmit the petition. The Court ordered the Registrar’s Office to note the withdrawal on the Registry Book and return the documents to the Petitioners.
“Determine, grant the withdrawal of the Petitioners’ petition. [The Court] declares that the petition of Case No. 146/PUU0-XXIII/2025] is withdrawn. [The Court] declares that the Petitioners may not resubmit the petition. [The Court] orders the Registrar to note the withdrawal of Case No. 146/PUU-XXIII/2025 on the Online Case Registry Book and return the documents to the Petitioners,” Chief Justice Suhartoyo pronounced the Decree.

At the preliminary hearing Wednesday, August 27, the Petitioners contended that the article had been ruled conditionally constitutional by the Court through Decision No. 90/PUU-XXI/2023. They claimed that the challenged provision caused them constitutional harm by depriving them of the right to have vice-presidential candidates who are mentally and physically capable of performing the duties of office.
The Petitioners argued that vice-presidential candidates must possess sufficient cognitive, affective, and psychomotor abilities, as well as a clear vision. Moreover, they should have proven track records, honesty, and integrity beyond reproach.
