Inheritor Questions 25-Year-Old Cap to Receive Pension

Jakarta (MKRI) – Petitioner of Case No. 150/PUU-XXIII/2025, Donaldy Christian Langgar, delivered his revised petition on Article 18 paragraph (4) letter a of Law No. 11 of 1969 on the Retired Employees and Their Widows/Widowers to the Constitutional Court (MK). The Petitioner challenges this provision because it sets the age limit for a child entitled to receive a widow’s/widower’s pension at “under 25 years old.”

“I, as an inheritor, am not categorized to be entitled [to the pension] because [the phrase] ‘under 25 years old’, Your Honor,”  Donaldy stated during the hearing on Monday, September 15, 2025.

Donaldy stated that if age it used as determinan and important aspect, there will be discrimination. There should be another requirements, such as unemployed and unmarried.

Due to the enactment of the article, the petitioner admitted to not receive his father pension payment.

Article 18, paragraph (4), letter a reads, “Children who are entitled to a widows/widowers pension or part of the pension according to the provisions of paragraph (1) or paragraph (2) of this Article, are those who, when the employee or pension recipient passes: a. have not reached 25 years of age, or.” According to the Petitioners, there may be a loophole in the law being challenged because he may be categorized as older than 25 years of age.”

In his petitum, the Petitioner requested the Court to declare the substance of Article 18 paragraph (4) letter a of Law No. 11 of 1969 contrary to the 1945 Constitution of the Republic of Indonesia conditionally as long as it is not interpreted as not reach certain age since it will have multi-interpretation.

The case was presided over by Justice Arief Hidayat, accompanied by Justice Enny Nurbaningsih and Justice Daniel Yusmic P. Foekh. (*)
