JAKARTA, MKRI – The Constitutional Court (MK) welcomed around 20 law students from Hasanuddin University (Unhas) on Monday, September 1, 2025. They were welcomed by legal analyst Muhamad Ramlan Aminuddin in the auditorium of the Constitutional Court’s main building in Central Jakarta.
On this occasion, Ramlan delivered a presentation on the background behind the establishment of the Constitutional Court. He explained that prior to the Court’s founding, many laws were problematic because they had never undergone constitutional review. In addition, the idea of presidential impeachment was often influenced by political interests, the resolution of disputes between state institutions remained dependent on the president, and there was no clear forum for resolving electoral disputes.
He also highlighted the lack of transparency in the mechanism for dissolving political parties, which had previously been handled by the Supreme Court (MA). “The establishment of the Constitutional Court provides solutions to these issues,” he said.
He went on to outline the Court’s authority, beginning with the composition of its nine constitutional justices as stipulated in Article 24C paragraph (3) of the 1945 Constitution in conjunction with Article 4 paragraph (1) of the Constitutional Court Law. He also explained the procedures of panel and plenary hearings.
He further elaborated on who has standing to file a petition for judicial review of a law (PUU). Referring to Article 51 paragraph (1) of the Constitutional Court Law, eligible petitioners include individual Indonesian citizens, customary law communities, public or private legal entities, and state institutions, provided they can demonstrate that their constitutional rights have been impaired.
Following the session, the students had the opportunity to visit the Constitutional History Center (Puskon) located on the fifth floor of the main building. The visit was expected to broaden the students’ understanding of the Court’s role in upholding the Constitution and safeguarding democracy in Indonesia.
