JAKARTA, MKRI — The Constitutional Court received an educational visit from Bengkulu University. The event held on Tuesday, (08/05/2025), at the Main Hall of Building I of the Court, aimed to enhance the students’ understanding of constitutional law, particularly the role and jurisdiction of the Court as the guardian of the Constitution.

The visit was personally received by First Expert Legal Analyst of the Court, Aditya Yuniarti, who delivered a comprehensive presentation on the institutional structure, duties, and functions of the Constitutional Justices, as well as the procedural mechanisms of hearings before the Court.

In her presentation, Aditya explained that the Court consists of nine Constitutional Justices, originating from three appointing authorities, namely the Supreme Court, the House of Representatives, and the President, each of which nominates three justices. At present, the Court is chaired by Suhartoyo as Chief Justice, assisted by Saldi Isra as Deputy Chief Justice, alongside other justices, including Ridwan Mansyur.

Furthermore, Aditya highlighted the importance of the judicial oversight mechanism implemented by the Constitutional Court Honorary Council (MKMK). “The MKMK consists of three elements: public figures, academics, and active Constitutional Justices,” she explained.

Aditya also elaborated that various working units within the Court support the duties of the Constitutional Justices. She emphasized that the Court’s procedural law is distinctive and differs from that applied in general courts. “The Court’s procedural law is specifically regulated under the Constitutional Court Law and is designed to support the institution’s constitutional functions,” she stated.

Regarding transparency, Aditya mentioned that the Court provides open public access to information through its official website mkri.id. The public may also attend hearings virtually without being physically present at the Court building. “We provide ease of access for the public from all across Indonesia. Hearings can be attended virtually, and decisions can be accessed online,” she said.

On that occasion, Aditya also outlined the stages of proceedings at the Court, which are divided into two types: panel hearings and plenary hearings. She further explained the concept of legal standing in judicial review cases, stating that the existence of constitutional rights impairment is the primary requirement for an application to be admissible. The Court assesses the extent to which the provision under review has a direct impact on the applicant’s rights. “Concrete evidence such as letters to the House of Representatives, public hearings, or academic studies is crucial in proving a direct correlation,” she explained.

Aditya added that while the Court is open to public participation, applicants must demonstrate good faith and active involvement in the legislative process. “It is not merely a matter of following the crowd on an issue, but of showing the existence of a legitimate legal interest,” Aditya stressed.

Since its establishment in 2003, the Court has adjudicated cases predominantly related to judicial review of statutes and disputes over regional head election results. The Election Law is among the most frequently reviewed regulations before the Court.

Aditya also highlighted several service innovations of the Court, such as the use of the Zoom platform for online hearings, the provision of a Digital Corner allowing visitors to print documents, and consultation rooms. After receiving the presentation, the students were invited to visit the Constitutional History Center located on the 5th and 6th floors of Building I of the Court.
