Dispute Petition Between South Kalimantan LPRI-Banjarbaru Gakkumdu Withdrawn

JAKARTA (MKRI) — Chairperson of the South Kalimantan Province’s representative council of the Indonesian Reform Monitoring Institute (LPRI) Syarifah Hayana has filed an authority dispute petition (SKLN) between the South Kalimantan LPRI and the Banjarbaru City Integrated Law Enforcement (Gakkumdu) to the Constitutional Court (MK). The preliminary hearing for case No. 1/SKLN-XXIII/2025 was heard by Constitutional Justices Arief Hidayat (chair), Anwar Usman, and Enny Nurbaningsih on Tuesday, June 3, 2025. However, the Petitioner’s legal counsels Alif Fachrul Rahman and Muhtadin expressed the Petitioner’s wish to withdraw the petition because she is focusing on her case at the Banjarmasin State Administrative Court and the Banjarbaru District Court.

“As legal counsels, we seriously filed a case against Gakkumdu’s actions, which led to the revocation of the LPRI’s status and rights as a monitoring institute and the naming of the DPD-LPRI chairperson Syarifah Hayana as a suspect. Although this petition’s objectum litis is not too strong because the object of SKLN is the authority regulated and granted by the 1945 Constitution, while Gakkumdu’s authority is not regulated by the 1945 Constitution, why we requested to withdraw this petition is because we are currently focusing on assisting the Petitioner for legal remedies  at the Banjarmasin State Administrative Court in connection with the revocation of LPRI’s legal status and assisting the Petitioner at the Banjarbaru District Court in connection with her status as a suspect, which was decided yesterday in pretrial,” Alif explained.

In the petition, the Petitioner stated that the institution had fulfilled various requirements as an election monitoring institution for in the 2025 revote of the mayor and vice mayor of Banjarbaru. It has also had a certificate as a monitoring organization from the South Kalimantan Provincial General Elections Commission (KPU). In the concrete case, originally two candidate pairs ran in the Banjarbaru mayoral election: candidate pair number 1 Lisa Halaby-Wartono and candidate pair number 2 Aditya Mufti Arifin-Said Abdullah. However, on October 31, 2024, the Banjarbaru City KPU had canceled the candidacy of candidate pair number 2 due to an alleged administrative violation of Article 71 paragraph (3) in conjunction with paragraph (5) of the Regional Election (Pilkada) Law.

Although the candidacy has been canceled, the Banjarbaru City KPU did not apply the single candidate pair system against an empty column as stipulated under the KPU Regulation No. 13 of 2018. The picture of candidate pair number 2 remained on the ballot paper, but votes for them were considered invalid. In short, the Petitioner’s alleged election violations were attempts to carry out the constitutional mandate in maintaining democracy in the implementation of the Banjarbaru mayoral election. However, she received a lot of intimidation and threats, and the institution’s status and rights as a monitoring institution was revoked and the DPD-LPRI chairperson Syarifah Hayana was named a suspect for an alleged case that was actually made up.

Therefore, the Petitioner requested that the Court declare that the Banjarbaru City KPU as Respondent did not have the authority to issue Decree No. S.Tap/54.a/V/Res.1.24/2025/Reskrim on the determination of suspect Syarifah Hayana, S.H. binti Said Muhammad Alaydrus dated May 12, 2025. In addition, she requests that the Court declare her to have the constitutional authority to file a dispute petition over the certification of vote acquisition of the election results of mayor and vice mayor candidates of Banjarbaru after the Constitutional Court’s decision, based on the Decree of the South Kalimantan Provincial KPU Decree No. 69 of 2025 on the certification of the results of the 2024 election of mayor and vice mayor of Banjarbaru, which was announced on April 21, 2025 at 23:30 WITA.
