PNS Withdraws Petition on State Ministry Law

JAKARTA (MKRI) — The Constitutional Court (MK) held the preliminary hearing for case No. 73/PUU-XXIII/2025 on the material judicial review of Law No. 39 of 2008 on State Ministries on Tuesday, May 20, 2025. Deputy Chief Justice Saldi Isra and Constitutional Justices Ridwan Mansyur and Asrul Sani preside over the hearing in a panel courtroom.

The petition was filed by Eko Susilo, a civil servant (PNS). The panel was supposed to examine the petition, but the Petitioner expressed his wish to withdraw it.

“I am withdrawing my petition for the reason referred to in my letter,” he said before the constitutional justices.

In the petition, the Petitioner questioned the use of the word “Department” in various official documents of the state. He argued that it was not aligned with Article 17 of the 1945 Constitution after the nomenclature change to “Ministry” in 2002.

He argued that legal documents that still use “Department” could potentially lead to legal uncertainty and violate the principles of good governance. The inconsistency, he said, could lead to administrative errors and decreasing coordination between government institutions.

He also proposed that such documents be allowed, in order to provide legal certainty, both to documents published between 2002 and 2010 and to the implementation of future substantial policies.
