JAKARTA (MKRI) – On Monday, February 24, 2025 in the plenary courtroom, the Constitutional Court (MK) rejected the petition filed by Candidate Pair 2 Daliyus-Heri Miheldi on the 2024 West Pasaman regent election results dispute.
“On the petition’s subject matter, [the Court] rejects the Petitioners’ petition in its entirety,” asserted Chief Justice Suhartoyo while reading the verdict for Case No. 43/PHPU.BUP-XXIII/2025 along with eight other constitutional justices.
In its legal consideration, the Court argued the petition was legally unreasonable, including the argument on the West Pasaman Regency KPU’s (Elections Commission) unprofessionalism, which led to inaccuracy in the data of the final voter list (DPT).
The Court stated that the update to the final voter list should have been anticipated of by the voters listed as per their residences following the provision of Article 12 paragraphs 1 and 2 of the KPU Regulation No. 7 of 2024, where it is conducted through voter data verification by the voters’ data update committee (pantarlih).
Furthermore, the Court rejected the argument that the West Pasaman KPU had arranged the final voter list that led to people having to vote far from their domiciles. It was reported to the West Pasaman Regency Bawaslu (Elections Supervisory Body) but was not pursued further as the formal and material requirements for the report were unfulfilled.
“Following the legal consideration above, the Petitioners’ a quo petition is legally unreasonable,” stated Constitutional Justice M. Guntur Hamzah while reading the Court’s legal consideration.
The Court also rejected the Petitioners’ argument on the improper distribution of the invitation of the C-notification forms (voting invitations) to the voters because the West Pasaman KPU had conducted disseminated the information.
The Court also believed that the distribution of the invitations was carried out by considering its effectiveness and efficiency. “Therefore, the distribution process of the C-notification forms to the voters was conducted as per the laws and regulations,” said Justice Guntur.

At the preliminary hearing on Friday, January 10, 2025, the Petitioners read out several arguments, including the difficulties experienced by the voters in the 2024 West Pasaman regent election. According to the Petitioners, some voters had to exercise their voting rights at distant polling stations, some voters even had to travel long distances of up to 20 kilometers crossing the island to cast their votes.
The Petitioners said that this had led to low voter turnout. Thus, they filed a petition requesting that the Court annul the West Pasaman KPU decree regarding the certification of the 2024 West Pasaman regent election results. They also requested that the Court order the KPU to conduct a revote.
