Vicky Prasetyo Missed Deadline for Pemalang Regent Election Dispute Petition

JAKARTA (MKRI) – The Constitutional Court (MK) ruled the petition for case No. 115/PHPU.BUP-XXIII/2025 filed by Candidate Pair 1 Vicky Prasetyo-Mochamad Suwendi on the 2024 Pemalang regent election results dispute inadmissible. The verdict was delivered by Chief Justice Suhartoyo alongside the other eight constitutional justices at the ruling hearing on Wednesday, February 5, 2025.

“[The Court] adjudicated, on the petition’s subject matter, Case No. 115/PHPU.BUP-XXIII/2025 is dismissed,” stated Chief Justice Suhartoyo.

In its legal considerations, the Court stated to have had the authority to hear the case. However, the petition was hampered by the deadline requirements. Under Law No. 10 of 2016 and Constitutional Court Regulation No. 3 of 2024, the petition for regional election results dispute must be submitted no later than three days from the announcement of the results of the vote acquisition by the KPU (Elections Commission).

As the results of the 2024 Pemalang regent election were announced by the Pemalang KPU on December 3, the election results dispute petition must be submitted no later than December 5. However, Vicky-Suwendi only submitted it on December 6, at 23:59 WIB and it was registered by the Court on December 7 at 2:07 WIB.

“[The Court] considers, because the Petitioners’ petition was submitted past the submission deadline as stipulated in Law No. 10 of 2016 and Constitutional Court Regulation No. 3 2024, the exception regarding the petition submission deadline was legally justified,” explained Chief Justice Suhartoyo.

Hence, the Court did not consider the Petitioners’ subject matter. This case also will not be continued at the evidentiary hearing.

At the preliminary hearing, Vicky-Suwendi (Petitioners) alleged frauds in the 2024 Pemalang regent election. Such alleged fraud, among others, was the distribution of parcels containing money and goods to the public prior to election day which included the logos associated with a certain candidate pair.

In the petitums, the Petitioners requested the Court to annul the 2024 Pemalang KPU Decree No. 2139 on the certification of the 2024 Pemalang regent election vote count recapitulation. They also requested the Court to order the Pemalang KPU or the Respondent to conduct a revote.
