JAKARTA (MKRI) – The Constitutional Court (MK) dismissed the petition filed by Candidate Pair 01 Nuryanto and Hardi Selamat Hood. This decision for Case No. 169/PHPU.WAKO-XXIII/2025 on the Batam mayoral election results dispute was delivered by Chief Justice Suhartoyo alongside the other eight constitutional justices at the ruling hearing on Wednesday, February 5, 2025 in the plenary courtroom.
In its legal considerations, delivered by Deputy Chief Justice Saldi Isra, the Court stated that the Petitioners’ petition failed to meet the formal requirements. Therefore, the Court had no doubt in declaring the petition unclear and vague (obscuur).
Furthermore, Saldi stated that since the Court found the Petitioners’ petition vague, other exceptions, the Respondent's response, the Relevant Party's statement, the Bawaslu’s (Election Supervisory Body) statement, and the petition’s subject matter were not considered further. With the petition being inadmissible, the case would not proceed to the next hearing.
“Arguments for the remainder will not be considered further, as they are deemed irrelevant,” stated Justice Saldi.

At the previous hearing, the Petitioners argued that Candidate Pair 02 Amaskar-Claudia committed a structured, systematic, and massive (TSM) violation in the 2024 Batam City mayoral election. The TSM violations included the partiality of structural officials/apparatus, violations of the neutrality of government officials, the National Police, and KPU (Election Commission) and Bawaslu as the election organizers. According to the Petitioners, the alleged violation resulted in a vote margin of 134,887 votes between the Petitioners and Candidate Pair 02.
