JAKARTA (MKRI) – The Constitutional Court (MK) ruled the petition for case No. 201/PHPU.BUP-XXIII/2025 on the 2024 Yapen Islands regent election results dispute inadmissible. The verdict was delivered by Chief Justice Suhartoyo at the ruling hearing on Wednesday, February 5, 2025 in the plenary courtroom.
“[The Court] adjudicated, on the petition’s subject matter, dismisses the Petitioners’ petition No. 201/PHPU.BUP-XXIII/2025,” stated Chief Justice Suhartoyo alongside the other eight constitutional justices.
In its legal consideration, the Court stated that the Petitioners had failed to meet the formal requirements. The Court explained that the petition filed by independent candidate pair Yuhendar Muabai-Yotam Ayomi was vague or unclear.
“The Court do not hesitate to declare the Petitioners’ petition is vague or unclear or obscuur,” asserted the chief justice.
Therefore, the Petitioners’ subject matter was not considered and not continued to the evidentiary hearing.

At the preliminary hearing, Yuhendar-Yotam, through their legal counsel, requested the Court to disqualify the other candidate pairs. They argued that all votes should have been transferred to them, resulting in the other candidates receiving zero votes. Their reasoning was based on the claim that the Respondent had disregarded Constitutional Court Decision No. 129-01-14-33/PHPU.DPR-DPRD-XXII/2024. The Petitioners contended that the decision should be interpreted as a mandatory requirement for candidacy by political parties.
Thus, in the petitums, the Petitioners requested that the Court annul the Yapen Islands Regency KPU (Elections Commission) Decree on the certification of the 2024 Yapen Islands Regency election results.
