JAKARTA (MKRI) - The Constitutional Court (MK) dismissed the petition filed by Candidate Pair 02 Sam Sachrul Mamonto-Rusmin Mokoagow on the 2024 East Bolaang Mongondow regent election results dispute. This decision was delivered by Chief Justice Suhartoyo at the ruling hearing for Case No. 105/PHPU.BUP-XXIII/2025 on Wednesday, February 5, 2025.

“On the petition’s subject matter, [the Court] declares the Petitioners’ petition inadmissible,” said Chief Justice Suhartoyo at the ruling hearing alongside the other eight constitutional justices in the plenary courtroom.

In its legal considerations, delivered by Justice Arief Hidayat, the Court stated that the Petitioners’ petition failed to meet the formal requirements, particularly arguments deemed unclear and vague. As a result, the Respondent's and Relevant Party’s exceptions were considered legally justified.

“Based on the legal considerations, the Court considered the Petitioners’ petition to be vague, other exceptions, the Respondent's response, the statement by the Relevant Party, the statement by Bawaslu (Elections Supervisory Body), and the petition’s subject matter were not considered further,” stated Justice Arief.

At the preliminary examination hearing on Tuesday, January 14, 2025, the Petitioners alleged intimidations by their rival’s campaign team. These were allegedly done to the voters at TPS (polling stations) 1 and 2 of Pinonobatuan Village, TPS 2 of Moyongkota Induk Village, West Modayag District, and TPS 1 of Bongkudai Baru Village, Mooat District.

In addition, another allegation involves vote buying, in which the investigation division of the East Bolaang Mongondow Police and the Modayag district supervisory committee (Panwascam) caught Abdullah Koi of bringing Rp12.6 million, which was the remaining cash that had been distributed to the people.
