JAKARTA (MKRI) — The Constitutional Court (MK) dismissed the petition for case No. 86/PHPU.BUP-XXIII/2025 on the 2024 Southeast Minahasa regent election results dispute, filed by regent-vice regent candidate pair 3 Djein Leonora Rende dan Ascke Alexander Benu. Chief Justice Suhartoyo delivered the ruling alongside the other eight constitutional justices in the plenary courtroom on Wednesday, February 5, 2025.
“[The Court] adjudicated, rejecting the exception on the authority, granting the exceptions regarding the petition submission period; on the petition’s subject matter: declaring the Petitioners’ petition for this case inadmissible,” said Chief Justice Suhartoyo while reading out the verdict for this case.
In its legal considerations, delivered by Constitutional Justice Arsul Sani, the Court asserted that the Petitioner’s petition passed the deadline for filing petitions as stipulated in Law No. 10 of 2016 (Regional Election Law) and Constitutional Court Regulation No. 3 of 2024. Consequently, the exception on the deadline to file submission to the Court was declared legally reasonable.

The Petitioners argued structured, systematic and massive (TSM) violations in the form of government involvement to secure the election victory for candidate pair 1 Ronald Kandoli and Fredy Tuda. The Petitioners alleged it includes organizing government activities and mobilizing government apparatus, such as local government unit (SKPD), village heads, and village consultative body (BPD) for campaign purposes.
As such, the Petitioner requested the Court to order the Southeast Minahasa Regency KPU (Elections Commission) to do a revote by excluding candidate pair 1. They also wished the Court would disqualify candidate pair 1 as they had allegedly committed a serious violation involving government officials.
