Petitioners’ Legal Standing Hampered Intan Jaya Election Dispute

JAKARTA (MKRI) – The Constitutional Court (MK) ruled the petition for case No. 292/PHPU.BUP-XXIII/2025 filed by Candidate Pair 2 Marten Tipagau-Malianus Belau on the 2024 Intan Jaya regent election results dispute inadmissible. The verdict was delivered by Chief Justice Suhartoyo at the ruling hearing.

“[The Court] declares the Petitioners’ petition inadmissible,” stated Chief Justice Suhartoyo at the ruling hearing alongside the other eight constitutional justices on Wednesday, February 5, 2025.

In its legal considerations, delivered by Constitutional Justice Enny Nurbaningsih, the Court explained that the Intan Jaya Regency KPU (Elections Commission) as the Respondent had carried out the recommendation of the Election Supervisory Body (Bawaslu) by postponing the plenary recapitulation meeting. Then, the Respondent conducted a recapitulation and data verification at the district level which was supervised by the District Committee.

In addition, a tiered recapitulation process was conducted by the Intan Jaya Regency KPU, which means the Petitioners’ petition argument is legally groundless. Therefore, the Court must follow the implementation of Article 158 paragraph 2 letter b of Law No. 10 of 2016 on the Regional Election Law regarding the threshold for filing a petition.

In the Intan Jaya regent election, the Petitioners won 24,995 votes and candidate pair 1 as the Related Party won 43,535 votes. It indicates a difference of 14.8 percent or 14.8 percent. "Therefore, according to the Court, the Petitioners do not have any legal standing to file the a quo petition," said Justice Enny.

The Petitioners alleged that the Intan Jaya Regency KPU as the Respondent issued a decision to certify the results of the Intan Jaya regent election secretly. This was conveyed in the preliminary hearing on Wednesday (15/1/2025).

The Intan Jaya KPU allegedly did not proceed with the recapitulation that was originally scheduled to begin on December 13 and conclude on December 14, 2024. This was due to alleged protests from the witnesses of Candidate Pairs 2, 3, 4, and 5, resulting in the postponement of the recapitulation session.
