Petition on Tana Tidung Regent Election Dismissed

JAKARTA (MKRI) - The Constitutional Court (MK) dismissed the petition filed by Candidate Pair 01 Said Agil-Hendrik on the Tana Tidung regent election results dispute. This decision was delivered by Chief Justice Suhartoyo at the ruling hearing for Case No. 210/PHPU.BUP-XXIII/2025, which was held on Wednesday, February 5, 2025.

“On the petition’s subject matter, [the Court] declares the Petitioners’ petition inadmissible,” said Chief Justice Suhartoyo at the ruling hearing alongside the other eight constitutional justices at the plenary courtroom.

In the Court's considerations, Constitutional Justice Enny Nurbaningsih explained that the transfer of state civil apparatus (ASN) carried out by the incumbent regent candidate was a step to enforce disciplinary law and a form of implementing ASN management. This was stated in a letter from the State Civil Service Agency (BKN) to the Election Supervisory Body (Bawaslu) of Tana Tidung Regency, which had previously received a report regarding alleged violations in the ASN transfer.

"Based on the entire description of the legal considerations above, the Court is not convinced of the truth of the main arguments of the petition," said Justice Enny.

Therefore, the Court could not override the implementation of Article 158 paragraph 2 letter b of Law Number 10 of 2016 on the election of governors, regents, and mayors (Regional Head Election Law) regarding the threshold for filing the petition. In the Tana Tidung regent election, the Petitioners won 8,547 votes and the Relevant Party won 8,982 votes. This means that the vote margin was 439 votes or 2.5 percent.

The Petitioners also alleged that Candidate Pair 02, as the incumbent, had misused village funds. The head of the social, community empowerment, and village services (DISPMD) of Tana Tidung was ordered to allocate Rp30 million to each of the following villages to support the campaign of the Relevant Party.(*)
