Petition on Merangin Regent Election Declared Inadmissible

JAKARTA (MKRI) – The Constitutional Court (MK) dismissed the petition on the 2024 Merangin regent election results dispute filed by Candidate Pair 01 Nalim and Nilwan Yahya. This decision for Case No. 180/PHPU.BUP-XXIII/2025 was read out by Chief Justice Suhartoyo alongside the other eight constitutional justices at the ruling hearing held on Wednesday, February 5, 2025 in the plenary courtroom.

In its legal considerations, delivered by Deputy Chief Justice Saldi Isra, the Court stated that the Petitioners’ petition failed to meet the formal requirements. Therefore, the Court did not hesitate to declare the petition unclear and vague (obscuur).

Furthermore, Justice Saldi stated that since the Court considered the petition to be vague, other exceptions, the Respondent's response, the statement by the Relevant Party, the statement by Bawaslu (Election Supervisory Body), and the petition’s subject matter were not considered further.

“Arguments for the remainder will not be considered further, as they are deemed irrelevant,” stated Justice Saldi.

At the previous hearing, the Petitioners argued the use of state facilities to campaign for Candidate Pair 02 Syukur and Abdul Khafid. M. Yuzan, a campaign committee member for candidate pair 2, had been alleged to use state facilities for campaign purposes during the Merangin Regency DPRD’s (Legislative Council) recess, which is prohibited. The use of state facilities could influence voters in the three districts near the recess activities. 

Therefore, The Petitioners requested the Court to order the Merangin Regency KPU (Election Commission) to conduct a revote at all polling stations of Merangin Regency.
