Petition for Donggala Regent Election Results Dispute Inadmissible

JAKARTA, MKRI - The Constitutional Court (MK) declared the petition of candidate pair number 5, Mohammad Yasin-Syafiah in the dispute over the 2024 Donggala regent election results inadmissible. This was conveyed by Chief Justice Suhartoyo in the ruling hearing of case number 162/ PHPU.BUP-XXIII/2025 on Wednesday, February 5, 2025.

‘In the main petition, [the Court] declares that the Petitioners’ petition for case Number 162/PHPU.BUP-XXIII/2025 inadmissible,” stated Chief Justice Suhartoyo, accompanied by eight constitutional justices.

In the Court's consideration, Constitutional Justice Arief Hidayat explained that the Petitioners did not fulfill the formal requirements of the petition. Particularly with regard to the reasons for the petition that are unclear or vague, so that the Respondent's and Relevant Parties' exceptions are considered reasonable according to law.

“Based on the legal considerations as described above, the Court is of the opinion that the Petitioners’ petition is vague and obscure, therefore other exceptions, the Respondent's response, the Relevant Party's statement, Bawaslu's statement, and the subject matter of the petition are not considered further,” said Justice Arief. By declaring the petition inadmissible, it is certain that this case will not continue to the next stage of the hearing.

Donggala KPU Denies Petitioners’ Arguments

The Petitioners argued three things in the petition, as follows: the partiality of village officials, the reciprocation of food staples, and money politics. This was conveyed in the preliminary hearing case no.162/PHPU.BUP-XXIII/2025 held by Panel 3 on Monday, January 13, 2025.

The Petitioner found evidence that the food items were distributed in four districts and six villages: Mbuwu Village in South Banawa District; Labuan Toposo Village, Labuan Lumbubaka Village, and Labuan Salumbone Village in Labuan District; Wombo Village and Guntarano Village in Tanantovea District; and Banawa District.
