Past Deadline, South Buton Election Dispute Petition Dismissed

JAKARTA (MKRI)  The Constitutional Court (MK) declared that petition in Case No.134/PHPU.BUP-XXIII/2025, filed by Candidate Number 4 Hardodi and La Ode Amiruddin, was inadmissible. This is because the petition was filed past the deadline for filing a dispute over the 2024 South Buton regent election results as stipulated in Law No. 10 of 2016 concerning regional head elections and in the Constitutional Court Regulation No. 3 of 2024.

On the petition’s subject matter, [the Court] declares the Petitioners’ petition No.134/PHPU.BUP-XXIII/2025 inadmissible,” said Chief Justice Suhartoyo at the ruling hearing alongside the other eight constitutional justices on Wednesday, February 5, 2025 in the plenary courtroom.

Constitutional Justice Arsul Sani explained that Article 157 of Law No. 10 of 2016 on regional head elections stipulates that the election results dispute petition is filed to the Constitutional Court no later than three workdays from the announcement of the certification of the election results by the Provincial or Regency/City KPU (Elections Commission). The Court stated that the Petitioners’ petition had passed the three-workday deadline.

“Therefore, with regard to other exceptions as well as the legal standing and the subject matter of the Petitioners’ petition and other matters are not considered because they are considered irrelevant,” stated Justice Arsul Sani.

The 2024 South Buton Regency election was contested by four candidate pairs, Candidate Pair 01 Samirudin–La Muhadi, Candidate Pair 02 Muhammad Adios–La Ode Risawal, Candidate Pair 03 Aliadi–La Ode Rusyamin, and Candidate Pair 04 Hardodi-La Ode Amiruddin. The Petitioners said that the three candidate pairs except himself and their respective campaign teams carried out structured, systematic, and massive (TSM) vote buying.

Referring to the South Buton Regency KPU Decree No. 716 of 2024 concerning the certification of the South Buton Regency election, the vote acquisition of Candidate Pair 01 Samirudin–La Muhadi obtained 11,424 votes, Candidate Pair 02 Muhammad Adios–La Ode Risawal gained 17,681 votes, Candidate Pair 3 Aliadi–La Ode Rusyamin received 14,242 votes, and Candidate Pair 04 Hardodi–La Ode Amiruddin received 2,799 votes. However, the Petitioners requested the Court to annul the South Buton Regency KPU Decree and certify the Petitioners as the winner in the 2024 South Buton Regency election.
