Past Deadline, Sarolangun Election Result Dispute Petition Dismissed

JAKARTA (MKRI)  The Constitutional Court (MK) declared the petition for the dispute over the 2024 Sarolangun regent election results, filed by Candidate Pair Number 3 Tontawi Jauhari and A. Harris Ab, inadmissible. The Decision No. 77/PHPU.BUP-XXIII/2025 was read out by Chief Justice Suhartoyo, accompanied by the other eight constitutional justices, at a ruling hearing on Wednesday, February 5, 2025.

“[The Court] adjudicated, on the exceptions: to reject the exception regarding the authority of the Court, to grant the exception regarding the deadline for filing the petition; on the petition’s subject matter, to declare the Petitioners’ petition No. 77/PHPU.BUP-XXIII/2024 inadmissible,” said Chief Justice Suhartoyo.

In the consideration read out by Constitutional Justice Arsul Sani, the Court stated that the Petitioners’ petition had been filed past the deadline for filing the petition specified in Law No. 10 of 2016 (Regional Election Law) and Constitutional Court Regulation (PMK) No. 3 of 2024. Thus, the exception regarding the deadline for filing the petition by the Court was said to be legally justified.

At the preliminary hearing on Tuesday, January 14, 2025, Candidate Pair 03 Tontawi Jauhari-A. Harris Ab claimed that district and village heads had shown partiality during the 2024 Sarolangun Regency election. This was said to have influenced the vote count, ultimately favoring Candidate Pair 05 Hurmin-Gerry Trisatwika (the Relevant Party).

Therefore, the Petitioners requested the Court to annul the Sarolangun Regency KPU (Elections Commission) Decree concerning the 2024 Sarolangun Regency election results and to order the Sarolangun Regency KPU to do a revote in all administrative areas in Sarolangun Regency without involving Candidate Pair 05. They also requested the Court to disqualify Candidate Pair 05 from the revote.
