JAKARTA (MKRI) — The Constitutional Court (MK) declared the petition for the 2024 Ambon mayor election results dispute, filed by Candidate Pair Number 3 Mohamad Tadi Salampessy and Emmylh Dominggus Luhukay, inadmissible. The Decision No. 246/PHPU.WAKO-XXIII/2025 was read out by Chief Justice Suhartoyo, accompanied by the other eight constitutional justices at a ruling hearing on Wednesday, February 5, 2025 in the plenary courtroom.
“[The Court] adjudicates, on exceptions: to reject the exception regarding the authority of the Court, to grant the exception regarding the deadline for filing the petition, on the petition’s subject matter: to declare the Petitioners’ petition No. 246/PHPU.WAKO-XXIII/2024 inadmissible,” said Chief Justice Suhartoyo.
In the consideration read out by Constitutional Justice Arsul Sani, the Court stated that the Petitioners’ petition was filed past the deadline for filing the petition specified in Law No. 10 of 2016 and Constitutional Court Regulation (PMK) No. 3 of 2024. Thus, the exception regarding the deadline for filing the petition by the Court was said to be legally justifieds.
Justice Arsul said that because the Petitioners’ petition had passed the deadline for filing the petition, the Court did not consider the legal standing, the subject matter of the petition, or other matters. It did not consider other exceptions other than exceptions regarding the deadline for filing the petition.
“Other exceptions as well as the legal standing and the subject matter of the Petitioners’ petition and other matters are not considered because they are considered irrelevant,” said Justice Arsul.

At the preliminary examination hearing, Candidate Pair 03 Mohamad Tadi Salampessy and Emmylh Dominggus Luhukay (Petitioners) alleged the partiality of election organizers. According to the Petitioners, all KPPS (polling station working committee) members at this polling station were suspected of criminal misconduct by attempting to cast multiple ballots for a particular candidate pair.
They had allegedly attempted to inflate votes for another candidate pair at TPS 42 in Batumerah Village, Sirimau District. Based on these allegations, the Petitioners requested that the Court order the Ambon KPU (Elections Commission) as Respondent to conduct a revote at all polling stations in Ambon City. They further requested the annulment of Ambon City Decree No. 431 of 2024 on the certification of the 2024 mayor election results.
