Obscure, Petition on Yahukimo Regent Election Dispute Dismissed

JAKARTA (MKRI) — The Constitutional Court (MK) dismissed the petition on the 2024 Yahukimo regent election results dispute. This case was filed by regent-vice regent candidate pair 2 Yosep Payage and Mari Mirin. Chief Justice Suhartoyo delivered the ruling in the plenary courtroom on Wednesday, February 5, 2025.

“On the petition’s subject matter, [the Court] declares the Petitioners’ petition for case No. 229/PHPU.BUP-XXIII/2025 inadmissible,” said Chief Justice Suhartoyo at the ruling hearing along with the other eight constitutional justices.

In its legal consideration, delivered by Constitutional Justice Enny Nurbaningsih, the Court explained that the Petitioners did not have legal standing to file the petition as their arguments were obscure.

“Considering the above legal considerations, the Court stated that Petitioners’ arguments were obscured, as such, other exceptions, the Respondent’s response, the Related Party’s statement, Elections Supervisory Body (Bawaslu) statement, and the petition’s subject matter would not be further considered,” asserted Justice Enny.

At the preliminary hearing on January 16, 2025, the Petitioners alleged the reduction and transfer of votes in the recapitulation process in ten districts by the Yahukimo Regency KPU (Elections Commission) as Respondent.

They also argued that the incumbent regent candidate Didimus Yahuli had abused his authority. The abuse started with the appointment of the district election committee (PPD), polling station working committee (KPPS), and PPD secretaries in 51 districts. The village heads also allegedly played a direct role in the ballot casting and vote counting at polling stations.
