Obscure, Petition on Tolikara Regent Election Dispute Dismissed

JAKARTA (MKRI) – The Constitutional Court (MK) dismissed the petition for Case No. 297/PHPU.BUP-XXII/2025 on the Tolikara regent election results dispute on Wednesday, February 5, 2025 in the plenary courtroom. The decision was read out at the ruling hearing presided over by Chief Justice Suhartoyo alongside the other eight constitutional justices.

“On the petition’s subject matter, [the Court] declares the Petitioners’ petition for Case No. 297/PHPU.BUP-XXIII/2025 inadmissible,” said Chief Justice Suhartoyo.

In its legal considerations, delivered by Constitutional Justice Enny Nurbaningsih, the Court asserted that the Petitioners did not satisfy the formal requirements of filing the petition, stating the Petitioners’ petition was obscured. Thus, the exceptions of the Respondent and the Relevant Party, which essentially states the Petitioner did not have legal standing to file a petition, was reasonable according to law.

“Based on the legal considerations described above, the Court is of the opinion that the Petitioners' petition is obscure and thus, the remaining exceptions, the response from the Respondent and the statements from the Relevant Party and Bawaslu (Elections Supervisory Body), and the petition’s subject matter were not considered by the Court," Justice Enny stated.

Candidate Pair 02 Nus Weya-Yan Wenda (Petitioners) had filed a petition for the Tolikara Regency election results dispute. The Petitioners argued that several violations had been committed and affected the vote count results, such as the failure to conduct the vote counting recapitulation for numerous districts.

Thus, the Petitioners requested that the Court annul the vote recapitulation results certified by the Respondent and order a recapitulation following the mechanism regulated in the laws and regulations. The hearing will be continued with further examination of the evidence and witnesses presented by both parties.
