JAKARTA (MKRI) — The Constitutional Court (MK) dismissed the petition for Case No. 104/PHPU.BUP-XXIII/2025 on the 2024 North Halmahera regent election results dispute, filed by Candidate Pair 2 Steward Leopold Louis Soentpiet and Maskur Abdullah (Petitioners) on Wednesday, February 5, 2025.
“[The Court adjudicated], on the petition’s subject matter, declaring the Petitioners’ petition inadmissible,” stated Chief Justice Suhartoyo reading out the verdict along with the other eight constitutional justices.
In the legal consideration, delivered by Constitutional Justice Arief Hidayat, the Court stated that the Petitioners’ petition did not fulfill the formal requirements of the petition. Since the petition’s arguments were deemed obscure or vague, the Respondent’s and the Relevant Party’s exceptions were deemed reasonable according to law.
“Based on the legal considerations stated above, the Court is opinion that the Petitioners’ petition is vague and thus, the remaining exceptions, the response from the Respondent, the statements from the Relevant Party and Bawaslu (Elections Supervisory Body), and the petition’s subject matter are not considered further,” stated Justice Arief.
At the preliminary hearing on Friday, January 10, 2025, the Petitioners raised an objection to the vote count results, which declared the Relevant Party as the winner. They argued that the victory was achieved through an unconstitutional process and involved structured, systematic, and massive (TSM) violations throughout the entire election process.
