JAKARTA (MKRI) — The Constitutional Court (MK) dismissed the petition by Candidate Pair Number 2 Bonefasius Jakfu-Abdul Ganing on the 2024 Asmat Regent election results dispute. This was conveyed by Chief Justice Suhartoyo at the ruling hearing for Decision No. 236/PHPU.BUP-XXIII/2025 on Wednesday, February 5, 2025.
“[The Court] declares the Petitioners’ petition inadmissible,” said Chief Justice Suhartoyo alongside the other eight constitutional justices.
Constitutional Justice Enny Nurbaningsih conveyed the Court’s considerations that the application of Article 158 paragraph 2 letter b of Law No. 10 of 2016 on the election of governors, regents, and mayors regarding the threshold for filing a petition cannot be disregarded. In the 2024 Asmat regent election results, the Petitioners received 20,042 votes, and Candidate Pair Number 1 as the Relevant Party received 37,235 votes. This means there was a difference of 17,193 votes or 30 percent.
“Moreover, regarding the a quo petition, the Court did not find any special conditions or events,” stated Justice Enny.

The Petitioners argued that the election, which was supposed to use “one person, one vote” mechanism, was changed to the noken system. This petition was delivered at the examination hearing for Case No. 236/PHPU.BUP-XXIII/2025 on Thursday, January 16, 2025.
In addition, the Petitioners argued that the regent Candidate Pair 1 Yoel Manggaprou had not resigned from his position as the member of regency legislative council (DPRK) for 2024-2029 according to the South Papua Governor Decree No. 100.2.1.4/410 of 2024 dated October 11, 2024. This clearly violated Article 32 paragraph (1) of the KPU Regulation No. 8 of 2024 on the candidacy of governor-vice governor, regent-vice regent, and mayor-vice mayor.
(*) The noken voting system is carried out by communities in Papua, either through public agreement on vote allocation or through the delegation of votes to a tribal leader.
