JAKARTA (MKRI) — The Constitutional Court (MK) dismissed the petition of Candidate Pair Number 2 Mohamad Agus Rahmat Lamakarate-Semuel Riga in the dispute over the 2024 Sigi regent election results. This was conveyed by the Chief Justice Suhartoyo at the ruling hearing for Decision No. 149/PHPU.BUP-XXIII/2025 on Wednesday, February 5, 2025.
“On the petition’s subject matter, [the Court] declared that the Petitioners’ petition for Case No. 149/PHPU.BUP-XXIII/2025 inadmissible,” said Chief Justice Suhartoyo alongside the other eight constitutional justices.
In its legal considerations, delivered by Constitutional Justice Enny Nurbaningsih, the Court explained that the editorial error in the Sigi Regency KPU (Elections Commission) Decree No. 211 of 2024 concerning the certification of the 2024 Sigi regent election results had not caused a juridical defect as argued by the Petitioners. The editorial correction of the State Administrative Court Decree is regulated under Article 52 paragraph (1) of Law No. 30 of 2014 on Government Administration.
Justice Enny continued, there is no reason for the Court to postpone the implementation of Article 158 paragraph 2 letter b of Law No. 10 of 2016 concerning the election of governors, regents, and mayors (Regional Election Lae) related to the threshold for filing the petition. There was a difference of 6.31 percent or 8,705 votes between the Petitioners, who won 46,496 votes, and the Relevant Party, who received 55,201 votes.
“Based on all the legal considerations above, the Petitioners did not have legal standing to file the petition, Justice Enny emphasized.

The preliminary hearing for case No. 149/PHPU.BUP-XXIII/2025 was held on Monday, January 13, 2025. Candidate Pair 02 Mohamad Agus Rahmat Lamakarate and Samuel Riga filed a petition requesting the annulment of the Sigi Regency KPU Decree No. 211 of 2024 concerning the certification of the 2024 Rigi Regency election results dated December 5, 2024. The Petitioners argued that the decree was legally flawed.
The Petitioners also alleged that the Sigi Regency KPU had committed a violation in this regent-vice regent election because several final voters who carried a notification letter (C-voting forms) had been denied the right to vote at the polling stations (TPS).
